A Wal-Mart worker died early Friday after an “out-of-control” mob of frenzied shoppers smashed through the Long Island store’s front doors and trampled him, police said.
The Black Friday stampede plunged the Valley Stream outlet into chaos, knocking several employees to the ground and sending others scurrying atop vending machines to avoid the horde.
When the madness ended, 34-year-old Jdimytai Damour was dead and four shoppers, including a woman eight months pregnant, were injured.
While nothing can match the horror of workers getting killed by stupid mobs and shootings in the middle of a Toys R Us, we keep receiving horror tales about other Black Fridays gone wrong. The biggest one is about how CompUSA/Tigerdirect online “sale”—the one with the Sony Vaio TT with a $5,000 discount was apparently a total disaster, according to readers. Update: A guy from the CompUSA “sale” wrote to us. Readers keep posting their stories about other places in the comments.

Please let it be known that everything about tigerdirect.com/compusa.com ’s “big” sale was a bust.
First it was not an online sale but a tele-marathon instead. Prices were valid only through phone lines which for half the night were actually dead. When the lines were working i was either on hold for a minimum of 20 min then hung up on or on the one occasion i got through was told that the product i requested was not on sale and then got hung up on. The crew for the live web cast lost video throughout the night.
Browsers were crashing, phones were crashing, all organization was lost. It was just a very unsatisfying experience for having spent 12+ hours tuned in to their product placement and free advertisement and still leaving empty handed. Now i realize everyone cries when they do not get their tickle me elmo but this seemed different.
I felt as though I was lied to. Quantities were not limited but scarce. They were based off donated products a fact that was no where to be seen in the advertisement. I don’t know. It is late, i am tired, and i somehow feel robbed even though i had no chance to spend money. I wrote you so this message did not get lost in the comments. I am a long time tigerdirect promoter but i am reconsidering my loyalty. So please just let me known. That this was a FAIL!
well i know people that went to the compusa.com web site and watched their live stream /pink Friday sale ALL day, essentially they would show an item on sale and give you an 888-444-9×00 number to call to try to order it.
i guess it worked ok until the last few hours when all their computers and cameras went out—they switched to a asus netbook to broadcast the last few items, including the coveted sony vaio TT laptop that lists t $6000, being sold for $999.
yes I tried desperately to call in for that, as did nearly the 5000 people watching…the last few hours had not only the problems with the webcast, but also audio sync, and then problems with the sale 888
phone lines, making it impossible to get through…..we need the net to complain to make compusa do the sale again or just sell more of the sony vaio tt.
The Compusa/Tigerdirect Pink Friday sales where a joke and I question whether or not anyone received any of the high demand products other than staff members and there friends.There where a few products which I had planned on buying mainly: i7 920 processors,x58 mobo’s,Nec projectors,Xbox360….. I had 3 phones auto-dialing the numbers.Since they were basically changing the phone# in sequence ie: 1-888-444-9300,1-888-444-9500,1-888-444-9800 repeat. I had the phones set to start dialing b4 they were put on the screen,as they put the number on the screen,and just after the number was put up. and would receive the “Item is already sold out”,”Please hold” message or would just plain get hung up on.
All in all it was ONE BIG SCAM!
A CompUSA guy wrote a reply to this story. He had this to say:
I also looked all over PinkFriday.org and I now have to agree with some of the customers who are complaining. I don’t believe that the deals and the ways in which they were delivered were explained. They did not say that the deals were only available through the phone and they did not explain that they only had a few units of each item. Perhaps they could have said, “Telethon style giveaways of extremely limited quantities.”
This is a small issue but it seems to have riled up a few people.
My final thought is this: Despite all the frustration and the technical difficulties, despite the fact that the explanation of the event was vague, despite the customer complaints, there were a lot of happy people and there was a ton of money donated to Susan G Komen.
Circuit City
I went to Circuit City to get a videocamera. They didn’t have the $200 JVC one that I really wanted. They didn’t have the $450 HD Samsung (marked down from $850) in stock. And, when I spotted a good $650 HD Sony videocamera, they wouldn’t do a $50 price match to CompUSA.
That’s right – Circuit City was unwilling to do an 8% price match for a customer in store ready to buy. In fact, I didn’t even get a counteroffer. At least a “I can’t do $610 but how about $630?” Is it any wonder they’re going out of business.
Could This Damage Your Car?
Inside a Jiffy Lube on Pico and San Vicente in Los Angeles, a service technician tries to sell an undercover NBC Los Angeles employee an “engine flush” or engine cleaning.
“Engine cleaning every two years, 30,000 miles is required for the vehicle,” the technician says.
But NBC Los Angeles has heard from customers across the country, who say their engines broke down after having an engine flush.
At the Jiffy Lube we went to on Pico, the technician says the engine flush will prolong the life of the engine on our Honda Accord test car.
An engine flush is where they pour a chemical solvent into your engine, supposedly to flush out old sludge.
When our undercover person asks, “is that something that Honda recommends?” Than technician says, “It requires it every two years, every 30,000 miles.”
That’s not true. Our car’s maintenance schedule says nothing about an engine flush.
“After engine flushes, there’s a pretty high incidence of some damage to the interior of the engine,” Chris Martin of Honda tells NBC Los Angeles.
That’s why Honda issued a memo to mechanics advising them not to perform engine flushes. Other major car-makers, including Ford, General Motors, and Nissan have all issued similar advisories against the service.
Why? Over time, gummy deposits can build up inside your engine. The chemicals used for engine flush, are supposed to break up those deposits. But car-makers say, pieces of that broken up sediment can clog up other parts of the engine and ruin it.
The car ran perfectly before I took it in that day,” says Pat Marriott. He took his Nissan Sentra to a Jiffy Lube in Kansas City. “They sold me, really sold me hard on an engine flush,” Marriott tells NBC Los Angeles.
He says three days later, on the highway his car broke down and he had to replace his engine for $5000.
That’s because Nissan and other car-makers say damage resulting from engine flushes won’t be covered by your warranty.
At other Jiffy Lube’s, like one on Overland in West Los Angeles, they offered us other services like a fuel injection cleaning. That’s where they put a chemical cleaner into your fuel injectors.
When the NBC Los Angeles undercover person asked the technician, “does Honda recommend that?” He said, “It’s every 15,000 miles or every year, recommended.”
That’s also not true. Honda and other big car-makers say fuel injection cleaning is an improper repair procedure.
“Using the cleaner, using a fuel injection cleaning system can cause harm to other injectors,” Martin tells NBC Los Angeles.
Jiffy Lube isn’t the only major chain recommending services car-makers say could be harmful. It happened to us at EZ Lube.
When our undercover person asked a technician at one of their locations in Silverlake, “Does Honda recommend an engine flush?” He replied, “They recommend… everything I’m telling you. We go by whatever the manufacturer recommends.”
Our undercover person asks him for proof, since EZ Lube’s computer lists all manufacturer recommendations, but there’s no engine flush listed. The undercover employee asks him, “How come they’re not on the computer?” The technician replied, “I don’t know.”
Across town at an EZ Lube near Santa Monica, technicians push a $99 transmission service using a high tech flushing machine.
Our undercover employee asks the technician, “does Honda recommend that it be done with a machine like that?” The technician responds, “Correct. That’s the only way you can do it.”
But Honda’s memo to mechanics clearly says “do not use transmission flushing machines” because of the risks to the car.
All told four out of five Jiffy Lube’s, and five out of five EZ Lube’s pushed services car-makers don’t recommend, but technicians told us the opposite.
We went back to the manager at that Silverlake EZ Lube.
“You said Honda recommends an engine flush. That’s not true. Why did you say that?” NBC Los Angeles Investigative Reporter Joel Grover asked.
“I don’t know,” he replied.
As for those technicians at Jiffy Lube who didn’t tell us the truth, they wouldn’t talk to us on camera and neither would their bosses.
Executives at Jiffy Lube and EZ Lube declined our offer to watch our undercover tape, and do interviews.
But in separate statements, both companies said it was unacceptable for their employees to misrepresent certain services as manufacturer recommendations, when they’re not.
EZ Lube says some of the employees we caught doing this will be terminated.
Jiffy Lube says they’re taking steps to minimize the chance of it occurring again and they want to hear from any unhappy customers.

Bed, Bath & Beyond Manager Who Refused 911 Call, Charged
Police have charged Elizabeth Miller, the manager of the Bed, Bath & Beyond in Lexington, Kentucky, who refused to let a couple use the store’s phone to call 911 to report a three-year-old locked in a van, and refused to make an announcement over the store’s PA system. The charge is “failure to report dependency, neglect and abuse, a Class B misdemeanor that carries a maximum sentence of 90 days and a maximum fine of $250.”
The county attorney quoted in the Kentucky Leader-Herald article points out that common decency should always trump any store policy, misinterpreted or not. In fact, it’s the law!
First Assistant Fayette County Attorney Brian Mattone told the Herald-Leader Thursday that under the duty-to-report statute, everyone has the duty to report dependency, neglect and abuse of a child if they have knowledge of it. Mattone said prosecutors thought that Miller, through witnesses, had knowledge of possible abuse or neglect. Moreover, there is language in the statute that says “nothing should relieve their obligation to report,” Mattone said.
The article also quotes another shopper who says she received a similar response from a different Bed, Bath & Beyond last summer when she saw a dog locked inside a car. Here’s hoping that the company’s “we’re ashamed this happened” response is authentic, and that their employees learn that it’s okay to offer help sometimes.
Jury orders Target to pay $3 million in civil case

A federal jury has ordered Target Corp. to pay a Greer woman $3.1 million after the jury found that the company distributed information that wrongly accused her of trying to pass a counterfeit bill while shopping.
The jury ruled in favor of Rita Cantrell following a three-day civil trial in U.S. District court in Greenville, according to a judgment filed Thursday.
In 2006, Cantrell brought a civil defamation lawsuit against Target alleging libel and negligence.
The suit alleged that a Target loss-prevention employee was responsible for an email distributed to dozens of other businesses and law enforcement agencies that warned them to be on the lookout for her after she tried to buy items from two Target stores with a legitimate $100 bill, according to a complaint filed in Greenville federal court.
In its answer to the complaint, Target denied wrongdoing and said that the email communication was “made in good faith.”
The email led the U.S. Secret Service to question Cantrell while she was at work at a Belk’s department store in Greenville, where she was employed in the store’s loss-prevention department, the complaint alleged.
Agents reviewed the bill — which was an older, 1974 series $100 bill — and determined she had done nothing wrong, according to the complaint.
The jury awarded Cantrell $100,000 in actual damages and penalized Target with $3 million in punitive damages, according to the judgment.
The lead attorney for Target, Knox Haynsworth, referred questions about the judgment to Target’s corporate office Thursday. The office couldn’t be reached to comment.
In its answer, Target says that its employee sent the email only to a loss-prevention employee at another department store and who also served as theft task force’s communication liaison.
In February 2006, Cantrell was a customer at Target’s locations on Woodruff Road and Wade Hampton Boulevard and was questioned at each location by employees when she tried to pay for merchandise with a $100 bill, which was rejected because it was a 1974 series bill, the complaint alleges.
A loss-prevention employee for Target composed an email that was distributed to a group known as the Carolina Organized Retail Theft Task Force, according to the complaint.
The employee’s email — the contents of which included images of Cantrell shopping and allegations that she had tried to pass a counterfeit bill and had shoplifted — was sent to 31 members of the group, according to the complaint. Members included local, state and federal law enforcement offices, malls, department stores, home-improvement stores and grocery stores, the complaint alleged.
The Secret Service went to Cantrell’s work and subjected her to a “custodial interrogation,” but after looking at the $100, determined the bill was genuine and cleared her of any criminal activity, the complaint alleged.
Following the interview, Cantrell was provided a copy of the email, according to the complaint.
“Every aspect of Rita’s life was harmed by Target,” said Bozzie Boggs, a Greenville attorney who helped represent Cantrell during the trial.

My balance was low in my checking account so I transferred money from my savings to my checking to over my debts. The next money I saw my account OD. They transfer I did the night before (I did online at 10pm) did not post. When I called customer service about it, they would not help me. They only told me my account was on hold until 2pm and I would not be able to use my account until then. EVEN THOUGHT I HAVE MONEY IN MY ACCOUNT AND TRANSFERRED THE MONEY FROM THE DAY BEFORE. I also got charged $35 per item that cleared.

A few years back I had opened an account with B of A. I also took out an auto loan with them. After a nasty divorce I went into ruin and my vehicle was repod and my accounts closed. I had UNKNOWINGLY overdrawn my account by $ .84 cents. They then out my information into a system that resulted in me not being able to open a bank account anywhere. I had no choice but to return to bank of america to open another account. At that time i was in the process of paying off all of my debts and had already payed off a $4,000 dollar credit card bill through them. The last thing i had was the remainder of the repo, after contacting them to set up some kind of payment plan, they were VERY eager not to help and it almost seemed like they were enjoying being diffuclt.
After some harsh words from their end i decided to try another day and work with another rep. They had other plans…. I had multiple savings accounts with them. I had one set up for the lawyer bills i have in my custody case that is still going on. To make a long story short, they zeroed out that account to put toward the repo account. I am now left with almost nothing and lawyer fees that i am unable to pay. I pray that I do not lose custody of my son over this.

I recently saw a $25 dollar charge on my regular checking account that I have had for 3 years. I never had this charge before. It stated Advantage Monthly Maintenance Fee. I looked it up and it is associated with the Advantage Checking account, which I do not have nor did I sign up for. I called BOA and inquired about it, they said I must carry a balance of $25,000 to avoid the fee. What? I don’t have that kind of money!!
Apparently they decided to enroll me in the Advantage account without my permission. I was told I was enrolled because I carry high balances and I have a mortgage I have never owned a home! When I tried to cancel the rep told me that I could no longer receive free checks. Oh, like free checks is worth the $25 per month you are going to charge me? Thats $300 a year! Glad they were able to refund and disenroll me. Still, this is illegal!

I’ve had my payroll check from Verizon Business deposited into my checking account with BOA for 3+ years now. I made an adjustment in my auto deposit, which resulted in me getting a live check, rather than having it deposited. When I took the check to the bank, they held the check for a week, causing several of my auto ACH’s to be charged a 35.00 NSF for each. When I contacted them about this, they suggested I get overdraft protection.
They were holding my paycheck hostage, and charging me 35.00 a pop for the pleasure of doing so!
My complaint is the lack of customer service, for a loyal customer, of over 10 years. Their pre-packaged auto responses are insulting and their lack of individual consideration based on a case by case basis, is ridiculous!

They did not care that it was the same company(l.a fitness) over and over trying trying to do a direct withdrawl.I called a few supervisors and they almost sounded excited to not help me out.

I wrote a B/A check to pay a pool installer. the work was really bad and the job was not completed. I telephoned Bank of America to stop payment of the check and was advised on several days the check had been stopped and I did not have to worry. Well guess what the check was paid.
I had to pay the $2000.00 plus interest to save my credit. I did close the account.

I have unauthorized withdrawals from my checking account of $25.90 from AOL and Bank of America refuses to get involved because I did not report it within 60 days. These charges caused my account to become overdrawn and they are charging me $200 in overdraft fees. In addition, I asked they close my account and that I would make monthly payments to them to clear up the debt and they responded we cannot close the account until the debt is paid. This means they will continue to pay AOL (who is not authorized to withdraw funds from my account) and charge me the overdraft fee. Furthermore, they will continue to charge me the $5.00 service fee each month. I explained to them I have not worked in over a year and the best I can do is make a small monthly payment to satisfy the charges and they will not accept that. So my account remains open and charges keep building because they refuse to close it. What type of business are they running?
Their refusal to close my account is costing me overdraft charges on unauthorized transactions and they continue to charge me $5 a month for a service fee when I have not used the account in over 3 months.

B of A held deposited funds for six weeks, well after the sending bank cleared the check, before allowing funds to be available in a small business checking account. Thereby, B of A could claim overdraft fees on funds they extended to pay claimed overdrafts; such credit extended without my written permission.
When notified no permission was granted, the bank should have closed the account but instead continued the overdrafting. All this occurred while there were sufficient funds in a linked savings account to prevent overdrafts.
The bank claimed no access to said funds when this was pointed out, claimed they had no signature from me. Then they started withdrawing funds to pay the bounced checks.
Six weeks later, the last deposit made and cleared from the sending bank has not been made available to my account.
I do not believe this to be harmless error.

I unfortunately was involved in an internet scam that was quite elaborate. I received a check that was deposited in a newly opened account separate from my regular account. A couple days after the check was deposited, the full amount of the check was available to be withdrawn, which to most people means a check has cleared.
I didn’t have my new card so I had to transfer funds to another account. Bank of America decided the check was phony, pulled it and canceled the account. Then they recouped the money they released from my account I transferred to. I lost $2200 on the counterfeit check.
They basically said I should read their fine print and that they can do nothing for me.

Last week, I went to Bank of America to ask for a reversal of a $12 fee. After I was refused, I withdrew $370,000 from the account. Later, it dawned on me that the Branch Manager (Yuba City,CA) allowed me to make the withdraw without showing a single piece of ID! She didn’t even ask for my social security number. All I showed her was a PHOTOCOPY of a single page of a recent bank statement. Any number of people could have had easy access to that (from my home office or garbage can).
I still hold a large account at Bank of America and am looking for reassurance that my funds are safe. If I had been anyone else other than myself last week, only part ($200,000) of those funds would have been insured. That Bank Manager put $170,000 of my funds at risk! I tried going online and calling several phone numbers to try and find out where to write a Letter of Concern to Bank of America and got nowhere. What to do?

I was charged three overdraft fees for the amount of $35 each time for overdrawing my account. I made the deposit before and was charged the amounts, so my account was showing as positive. I did a transfer of one dollar to another account. Now the bank said they will charge me again 35 dollars for overdraft fee because the transfer was cleared later than the time I did the transfer. And after charging me with three overdraft fees my account was negative, and was what caused the one dollar charge to make another transaction over the limit. What looks like to be caused by the bank. A month ago I was charged an annual fee of 29 dollar that cause my account to be over the limit. The bank charged me again a 39 dollars over limit fee that was caused by them.
I have no money to eat. My budget is small and all these charges will make my life harder. It may seem small money for others, but I believe I should earn my money honestly to live. I believe such a behavior from the part of a financial institution is not fair. The charge could be avoided. First if I could have the option not to allow transactions to go through If I had no funds in my account. Second, If the over limit fee would be charged right after I was overdrawn. Now I have no money to pay for gas and no money for food because I am charged three times, not one time the overdraft fee. This would be much more fair if reduced to one fee.

After waiting for a period of time, Tej Randhawa of Bank Of America in Sunnyvale has wasted my time to deposit a client’s check that they stated will only take a few minutes. After waiting, Tej has decided to tell me I can cash my check elsewhere as I told him I will wait patiently as I stood in line for a period of time to get my check cashed. I need to move forward with the project; my client has signed a budget for products which now has been delayed. After speaking with my client, they were upset and I had explained to him that I cannot accept any more checks from Bank of America as they were charging $5 per check which delays every project that is assigned by my client.
As stated by the client, they are very upset and had to be apologetic for Bank of America’s actions, represented by Tej Randhawa of Bank of America. During the waiting period, the check was not verified in any way as Tej just sat there looking at me and not taking action. Definitely would overview his skills as a bank associate.
This has damaged the clients reputation due to their BofA banking affiliation. The job cannot be complete since payment was not collected or verified to cash a budgeted project.

If you want to dispute a charge to any of your accounts that a company has made without your authorization, BofA will allow you to file a dispute. However, when I call to dispute a charge BofA made to my personal checking account, I was told there was no way to dispute the charge, let alone file a complaint. This is illegal.

My complaint is on on Bank of Smerica, p.o. Box 25118, Tampa, Florida 33622. The issue is their check depositing practice. I have been a customer since 1999. Because I have had issues with Bank of America before, I stopped depositing my work check electronically to them. Last week I deposited a check from my credit union account, and on Monday I checked the status, and it was placed on hold; but when I called my credit union, which is in California, the check was cleared! I called because the money was to move into an apartment, and I was supposed to give the money to my new landlord and had a deadline to leave my present apartment.
I spoke to a rep and supervisor, and neither seem to have a solution for me but to wait until Friday! I offered to have the credit union to fax proof it was with drawn, and the rep couldn’t even figure out who to direct the credit union rep to, to send the fax to show it was taken out. The credit union couldn’t understand the hold nor the rep and supervisor’s lack of knowledge on how to help me. I would like Bank of America to tell me why would they put a hold on my check? I’ve never had a returned check with the company!
I have to move my things to storage for 2 days! And my 4-year-old and I have to go to a hotel.

This incident was happening around 1997. I would always deposit my husband’s paycheck every Friday (a FedEx company check) into the Westchester Branch’s ATM Machine, even though our Branch was in Culver City. Every month they seemed to lose 1 of his paychecks and not post it until about 1 month later. Oh, I would call the bank as soon as I made the deposit to check and see if they got it. They would say it’s in a misc. bank account because we did not know what account# to post it to.
I told them the acct.# is on the back of the check–how can you not know? Then they started charging us NSF’s, overdrafts, etc., and never credited our acct. Finally I left for WELLS FARGO BANK.

I put in a PayPal transfer to my checking account on March 4, 2008. PayPal put the status as Completed at 20:29:01 PST. I wrote a check to my child’s school with PayPal showing that the trasfer was completed. Bank of America (BoA) didn’t put a hit back to PayPal until March 7, 2008 so the check that I had written to my child’s school put my account into overdraft. As of 1:35AM on March 7, 2008, the check withdrawl was still pending so I thought I was alright and that the transfer would go through BEFORE the check was deducted from my account.
BoA applied a $35 overdraft fee to my account AFTER they processed the deposit. Even though deposits are supposed to be processed BEFORE withdrawls, they still processed the check on March 7, 2008 BEFORE the deposit. Not only was the customer service people rude but one customer service representative stated to me that the overdraft fee WAS refundable and that it WAS banking error, but then when I called back asking why the overdraft fee had not been refunded yet, they informed me that it was not refundable and they were going to keep the $35 overdraft fee.

My husband and I transferred $1000 from our Bank of America in Sunland, California. The date was Nov 15, 2007. We transferred it to our account in Costa Rica, at Coopemex, San Jose, Costa Rica. Our account was billed for the $1000 and also a wire transfer fee of $45 approximately. The money was taken from our account, and it never arrived to our Costa Rica account. We discovered this when we went to Costa Rica for a vacation, and the money was not there. Additionally, when we tried to phone B of A from Costa Rica, even though we phoned toll free numbers, we were billed for the calls totaling about $50. We have attempted for weeks and weeks to resolve this, and we are getting no help from B of A. Our money was stolen.
We are being denied the funds and any interest it might have accrued. Plus we are being billed for the phone calls to try to resolve it. This is theft.

I deposited my husband’s check into my account at a local ATM. It is a small town, everyone knows everyone; the bank mailed it back to me stating he was not on my account, which caused 4 items to bounce, charging me $140.00. I called their customer service line. The rep there told me that the check was on hold until midnight, and that the funds would be released. But this didn’t happen.
Bank of America refused to credit me the overdraft fees, even after they admitted they were wrong.

I opened a Prima Account through a branch and specifically told the staff that I have mortgage with BA, so any fees associated with Prima account would be waived. This is my 2nd Prima account, so I knew how the process would be. Unbeknown to me how incompetent the staff would be, she opened my account without notating the waived charges. Therefore, from 9/2007 to 3/2008, my account has been charged $20 monthly service charges. I called in March 2008 as soon as I saw these charges on my statement. I went to the branch and called the 800 #; the only thing they were able to do was to credit me for 3 months. I would have to be responsible for the other lost fees because I wasn’t checking my statement. I am still very fired up regarding this issue, as it was a staff problem by BA; and they should be liable for this and give me back my money!
I suffer monetary damages by these service charges, lost time and effort in attempts to try to resolve issue, but efforts were worthless.

The bank cashed a stale-dated check almost 10 months old that I had credited back into my account. I did this after waiting 6 months for it to clear. When I paid my mortgage that month, my check bounced for insufficient funds, and they charged me a $35.00 fee. They claimed the check is good up to 7 years if presented. I used to work in banking, and I know it does not cost them $35.00 in expenses to handle an overdrawn account.
I had to scramble to cover the difference in the account as well as fees and to make sure no other checks hit the bank before the fees were covered, or they would return them and charge me an additional $35.00 each.

Today I received an email from Bank of America saying they put my balance to below zero and are going to take my direct deposit check on Friday. I simply deposited a check I received from the State Treasurer’s office, and they made it available. Then 5 days later they said they returned it to the Treasury. I need help a.s.a.p.
So far they are charging me $95 for overdraft charges. I also have direct deposit going to this account which they say they will take. I also have direct payments coming out of this account. This has caused me to be sick all weekend with this unending mess up. Please help.

There is no way I signed up for Credit Protection Plus. After digging further, Bank of America uses a third party company called CIC which administers the plan. I was charged two big fees before realizing they fraudulantly enrolled me in the plan and the last charge pushed me over my credit limit which alerted the credit bureaus that I am over the limit.
I’m currently fighting with Bank of America to get back the fees charged and get them to straighten out the over the limit notification to the credit bureaus.

I was signed up for an Insurance Plan to which I never agreed; when I tried to cancel, they said it was taken care of. I was busy moving to a new area, and I wasn’t aware the entire time that the Fee for the plan I never wanted was causing me to become overdrawn. Their own overdraft fees were further causing me to become overdrawn even more so; they kept multiplying until it got to $711+.
I lost money out of my account. I lost months’ worth of Fees for a plan I never ordered. It ruined my credit.

On 01/16/08 a $3,100.00 check from a State Farm Insurance settlement was deposited on a regular BofA ATM machine. A week later I called BofA customer service 800 number to ask about it, only to find out that the check was never cashed because it was issued under my name as well as my boyfriend’s name. I asked the banker to send me the original check to my current address.
It has been more than ONE MONTH after I initially tried to deposit the check. Bank of America loses my check. I ask BofA to send me a copy of the check, and I receive something totally worthless. I was then misled to believe that I could deposit an invalid document, then I am told to wait one more week after a month of waiting for the check. I WAS COMPLETELY FRUSTRATED WITH THEIR RESPONSES AND CUSTOMER SERVICE!
I am now behind on my credit card payments, utility bills, student loan bill and medical insurance bill. My bills are pilling up, and my credit card may file a claim against my credit report. If I don’t get this check cashed soon, my situation will worsen, and my credit will be severely affected. I need serious help to sue BofA of moral and financial damages that this has caused me.

Nothing has been done, and I have no way to communicate. The only phone number I have is an answering machine. Thank you to tell me how I can speed up the process and be sure it will be done.
The consequence is I am now without money to create the new business I have to create.

I was admitted to the Veterans Administration Medical Center in Asheville North Carolina on July 9, 2007. I was discharged on July 19, 2007 after receiving 3 units of blood, 1000 milligrams of iron and platelets. I was given a diagnosis by the cancer doctor at the VA hospital August 13, 2007. I was told that I had had acute myeloid leukemia for at least a year and had approximately one year to live. I was hospitalized again on October 27, 2007 at Park Ridge Hospital in Fletcher North Carolina. There, I received both blood and iron and was discharged November 5, 2007. I have credit cards with Bank of America, Household Bank, Providian (Washington Mutual) and Chase Bank. Although I had Credit Card Protection with all of them, ONLY CHASE BANK immediately deferred my payments with zero interest from the time I let them know I had cancer. I called Chase Bank; they gave me time to send proof of my condition, it was that simple!
Bank of America has referred my account to a collection agency! I have had a 60% military related disability for several years; however, since the diagnosis of acute myeloid leukemia, I am now 100% disabled. My medical and personal expenses have risen significantly, and I haven’t been able to be as independent as I was previous to my first hospitalization in July of last year. I’ve been treated by a doctor who wrote a letter for me stating I was 100% disabled, which I sent to all the credit card companies/Credit Protection Agencies along with a pathology report. Since becoming 100% disabled as of July 9, 2007, I haven’t used any of my credit cards, while continuing to make all my payments (with the exception of Chase Bank) through November 2007. During this time I was repeatedly faxing and mailing reports, and calling to inform the credit card companies and their Credit Card Protection Agencies of my condition.
Every day I’m STILL RECEIVING calls from representatives of the credit card companies. Sick people do not need people calling them from 8:00 am till after 8:00 pm, and even on weekends. My doctor says this continued pressure by the credit card companies is to stressful for me and is not good for my condition. Two years ago I sold my home. The people who bought my home defaulted on the first mortgage, and I lost over fifty thousand dollars because I had agreed to hold a second mortgage for them. Losing all that money did not create as much stress for me as the credit card companies/Credit Protection Agencies are generating for me at this time in my life! Thank you.

I am convinced that Bank of America is profiting from charging bogus overdraft fees. When making cash deposits prior to the cut-off time, I’ve been told it would post the same day only to find out they post the following day, which has resulted in overdraft charges. Also I paid $28 to do a stop payment on a transaction only to find out after they sent the transaction through and that it takes 3 days to stop the payment. There was nothing in writing stating this and the customer service rep who helped me never mentioned it when I paid the $28, which was deducted from my account immediately. Then when I called customer service, they told me there was nothing they could do; but, valued me as a customer.
I have lost over $200 to the bank of america in overdraft fees alone because of misleading information from the bank. I’m a single mother with two children and I can’t afford to give away that much money, especially when I feel I’m following the necessary procedures to keep my account in good standing.

I opened a checking account online with a savings account. Months later BOA converted because of to many withdrawals. I understand the change to a checking due to the issue. However, they convienently forgot to switch the automatic savings plan off since it was no longer going into a interest bearing savings. This has caused many headaches for me.
First, I had enough money to cover a payment for a purchase I made with this feature they forgot to take off with the switch they charged my account a NSF fee and trans fee of $10. I went back through my records and BOA did this to me on multiple occasions. They said it was my fault because I didn’t notify them and would not refund any of the money. The estimated total last year had to be over $100 in the $10 fees and almost another $100 in NSF fees. When I complained they said it was my fault. I asked if they converted the account why didn’t they take that feature away since it was not a savings? They replied it is my responsibility to tell them. I find that somewhat amusing seeing they made the changes to the account and never told me I could have the keep the change savings on a checking account. I know you might think why did I not notice this sooner and it is simple, $10 leaving my account at a time I just didn’t notice, but a deeper look into my account upon the year review I find out. I was also told if I replenish my account the same day prior to 2pm I would not be hit with NSF fees. Each time I have done this they have denied my request. I currently have 1 investment account with BOA, 3 Checking. Out of all the banks I have banked with Bank Of America has the best service to your face but lacks delivery
Because of this I am now short my car payment and is adding much undo stress.

I made a deposit of 731 dollars into my account which has now disappeared. I contacted the branch and they have no clue what happened to the deposit and they weren’t going to take further action until I showed them a deposit slip. Luckily for me, I save these slips just in case. Now, they have made an investigation even though they can clearly see the deposit isn’t showing and I have proof of this deposit. I am waiting for a check to go in for my rent and I am totally worried because they are taking 24-42 hours for the investigation. How can this have happened?
I still need my $731 to be posted into my account otherwise I might get a 3 day notice and a bounced check on my car payment.

I signed up for a checking account on Nov 30, 2007. A bank representative offered me a credit card with BOA which I took. At NO TIME did I agree to Credit Protection Plus which was somehow added on without my permission. I was billed approx $90 per month. I have been out of town for 2 months and paying my bills online therefore did not notice the charge for over 60 days until I saw the actual statements. Neither Credit Protection or Bank of America will refund the money that was stolen from my account without my authorization.
I have spent time and money – cell phone bills, time from work, etc trying to resolve this issue. I even contact corporate headquarters of Bank of America. BOA says there is nothing they can do. I cannot believe this company has been allowed to steal from me and no one will do anything about it!!

We closed all our accounts with Bank of America in Oct. and Nov. of 2007. This includes all checking, savings and visa accounts. On Friday, Feb.1, we received a letter from Keith Palmer stating that he had in fact closed one of our accounts due to a history of delinquency with our creditors. Not only have we had to literally fight to close our accounts with Bank of America, but now we are receiving mail that in fact slanders our name and credit rating. The letter gives no dates or proof. This sort of treatment has been going on for some time, and we are feeling not only slandered but feel they are in fact harassing us and our good name. We have the closing receipts showing the dates all accounts were closed. The letter received from Keith Palmer is dated for Jan. 24, 2008–clearly after the date that all accounts were in fact closed by us.
This constant treatment is causing great stress and despair. We are feeling threatened by this constant harrassment and the possibility that they could damage out credit. We don’t understand how can this sort of treatment go on in this country?

Ihave noticed that Bank of America charged me $350 in overdraft fees because they charged out first from the big amount and them the small amounts, to make you fall in overdraft fees–even though you have spent small amount in the morning and the big amount after 4 pm. For Bank of America, it is when you withdraw money from your account after hours (4 pm), they won’t count it for next day transaction; but if is a deposit after hours, they will credit it on the next day transaction. That is how my account falls on overdraft.
These frequent overdrafts are causing economic problems. I thought Bank of America will base it on the interest of their loans–no, from billions of dollars they charge their loyal customers.

I opened a online CD after seeing an ad in Bank of America website for APY 4.85. However after signing up, the bank gave a rate of apy 4.75%. My complaint is about the time taken to reach a customer via telephone and their ability to resolve the problem. On the first attempt I spent nearly 50 minutes and gave up. Because they transfer from one dept to another and so on. And at one point, the system disconnected. BofA ask so many questions in the name of verifying my identity and finally that guy doesn’t resolve, again goes to another dept. I did a simple math for the interest amount that I will lose on a .1% which is about $8 for 4 month. So I decided to give up instead of wasting my time. On a different note, I want to notify them about the maturity date and it is so far taken 20 minutes to reach them, so has to disconnect. Poor Service. I will not choose BofA in the future and eventually I will close all my business with them. Another funny thing they provide in the cd receipt of associate phone number as 800-432 1100 which takes to a bad entertainment line.

I went to Bank of America to cash a cashiers check I received for $4,000. I asked the teller if there is some way to verify the funds, or verify the check. The teller said this is a cashiers check, it is guaranteed funds–meaning there is no way it won’t go through. I depended on the teller’s promise to me that there is no way there will be a problem with the check. I wrote a check back to the sender of the $4,000 for $2,400, and found out that the check was later canceled as fraud. (I later find out this is a huge scam.)
I never received my $4,000, and the Bank of America teller TOLD ME it was guaranteed. I want them to be held responsible for this, as I was suspicious: but when they assured me everything was fine, now I lost $2,400.

On Jan. 16 I unintentionally overdrew my account by .93 cents. The next day I deposited $140.00; however, the damage was done. I have received four $35 charges totaling $140. I am presently overdrawn by $53.34 and have no way of catching up. I was told to take a register because I don’t know how to count.
Instead of having money in the bank I am charged $140–at a time when I am just returning to work after being laid off for 2 months. I do know how to count, and charging 140 dollars for a 93-cent mistake is criminal.

My personal checking account was debited $5600 without any notification because they stated that my husband owed a balance of B of A credit card. I asked what that had to do with my personal funds and was told his social security number was traced and his name was added to my account.
I pulled the signature card because I did not personally added him to my acct. The rep stated that it looked like my handwriting when it was clearly obvious it was not. How can someone come inside a branch and add a name without the account owner present?
I asked them to return my funds because firstly, i did not add him to my account and secondly my name was not on his credit card application as joint. This happen 12/31/07, and they keep giving me all these crazy reasons as to why they feel this was appropriate.

My husband and I have our business account with Bank of America. On Jan 15, 2008 a $867.24 check was debited twice from our account. I called the bank and the customer service rep said she filed a dispute and the money would be credited to my account in two business days.
I called again on the 18tf and the rep said it would be credited on the 19th. I was told on the 19th that the first rep was incorrect and that it takes 2 to 5 business days. I told them that I wanted to know the exact date that the money would be credited. She said it would be no later than the 24th of January.
I am very confused about this situation. Once the bank made the error on the 15th, it should have been immediately credited.

I went to Bank of America to cash my paycheck (as I do every two weeks). They handed me a counterfeit $100.00 bill, and of course I did not realize it until I tried to use it to pay a bill. The person I gave the money to, retained the bill. I went back to Bank of America after realizing what happened and their answer: Sometimes that happens!
WHAT? Do they not have a way to check their bills? This is ludicrous! This may not be a lot of money to them, but I am a retiree on Social Security and certainly cannot afford to lose a penny, let alone $100.00. They acted as though, “so sad, too bad”. I just simply want people to know that their common practice is not to check their bills!

A few months ago I noticed that Bank of America’s billing system was putting the due date on the weekend. However, their online payment system will not allow you to use a weekend date. I called after the January payment was credited to my account on the 14th to ask that the late fee be removed. I was told “No, we are not going to do that.” After an exchange with a rude customer service rep, I asked to speak to a supervisor. The rep told me “It will not do any good; she is not going to remove it either.” At that point I informed her that I wanted to report her bad attitude; I’m still waiting for their call.
My problem is the due date always seems to move to a weekend date, and I should not have to pay the bill early. If their billing system will use a weekend date, their payment system should also use it. I beleive that it is just a way to get an additional $39.00 out of their customers. Luckily I have been able to surf almost the entire balance to other accounts to get BOA out of my life forever. They are legally allowed to steal from their customers in the form of fees.

Bank of America just loves to complicate things. Their online bill-pay service is intentionally misleading and deceptive. I paid someone $150 with this service. It was set to be delivered on a specific date. On that day the website said it was sent, and the funds were withdrawn from my checking account–except they weren’t. I noticed the balance had not adjusted. I called the 800# to ask about it, and they said they do not withdraw funds for at least 24 hours. But that’s not what bill-pay said; bill-pay said the withdrawal was made the day the payment was delivered, nothing about a delay. If I had not caught that I would have spent money that was already spent.
There can be no reasonable explanation for this other than BOA hopes to trip you up and nail you with overdraft fees. It’s the same reason online banking is as ridiculously complex as it is–with pending charges and delayed deposits; nothing is in real time. The balances you see are never the actual balances. It’s like everything they do is oriented toward pumping more outrageous penalty fees out of you. What ever happened to honorable business practices? BOA is more like a slipshod bazaar.

I did a wire transfer using Bank of America in Baltimore, MD to my own account in India using SWIFT codes. I was told that India is a slow to pay country and it takes about 3 weeks and no investigations would be done till then. It has been 2 and a half months and it hasn’t gone through. My bank in India has not received any information regarding this from Bank of America and Bank of America is not willing to help. Every time I contact them, they tell me that they are sending e-mails to the bank in India to find the status and that the money is in India and nothing can be done about it and it is possible that I might lose my money. I have no clue as to how to go about it. Please help!
I had sent all the money from my first pay-check to my parents for Diwali. It is a huge amount for me coming from a lower middle class Indian family. It is emotionally traumatizing to see the callous attitude of the Bank of America Customer service and investigations department. I don’t know what to do.

Last 3/2006, called into BOA to check my account balance, and found that I have been charged $300 for a safe deposit box! I have called their customer service operator and have been told that I am listed as an owner of the box. I have tried to explain to the person/s who I spoke with that I was not the owner, but rather, the signee to have access to the box in the event of an emergency! I was told that I would need to speak to the branch location to have my matter resolved.
On numerous occasions I have tried to speak with both the bank manager and general manager for that location; to this date have had no response. This bank is located in Hyattsville, MD on Annapolis Road. I am so-o-o fustrated with BOA and the lack of support they give to their customers. So much lost time has been spent, and the issue has not been resolved. I continue to get the run around. I will be closing my accounts with the bank and going with another bank.

Bank of America denied payment on Jan. 4, 2008 of a credit line check issued Dec. 28, 2007 in the amount of $7000 to solve a business collection account. The bank later claimed that they had unilaterally closed this account without notice to me on Jan 4, 2008. A letter dated Jan 4 was received in the first class mail on Jan 15 stating that the account was closed. Their explanation was that one payment on this account was late, but no notice of the payment being past due was ever issued until after this account had already been close.
This has severely damaged the business recovery plan that sought to solve a corporate collection account balance.

Bank Of America has charged me a fee of $100 because they received a court order to garnish my checking account. They said it was non refundable. If any one is going through some financial difficulty wouldn’t your bank be the first place you would go to for help? I lost my job 9 months back and things became tight. Some of my creditors were put on the back burner because keeping my house was my main focus. I’m now just starting a new job. I feel that the fee my own bank charged me is very unethical or should I say down right wrong.

All of my bills are due on the 8th, since I prepare bills the end of the month. I was with MBNA, and when Bank of America bought MBNA, I arranged for a payment due date of the eighth of the month. It has been about a year since B of A has the account. Preparing bills the end of Dec, I noticed the bill was due on the first of Jan!There is no way the mail would get the payment to B of A in time to avoid a late fee! I called on the telephone and made the minimum payment, $15, (sent in by mail half of the outstanding balance that day also), and was told there was a $15 fee for a telephone payment. I complained about the date change without notification, and was told essentially that the old due date will be re-instated, but I have to pay the telephone transfer fee–and be thankful I did not have to pay a late fee of $35! Boy, that is scraping the bottom to make a (dishonest) buck. I will not be using this card in the future. I expected better from B of A. Be on guard!!
Loss of $15 that is due to Bank of America’s shifting my payment due date with notification. Not a lot of money, but a lot of nerve.

My son has a campus checking account in my name and his. He made a debit card transaction on 11/29/07 that didn’t show up in his account until 1/7/08. We thought it had cleared back in November. It did not show up as pending on my online banking; it just cleared overnight. Due to BOA’s policy of processing the largest debits first, down to the smallest, this transaction, which should have caused, at most, one overdraft fee ended up causing five, totaling $175. BOA, after I pitched a fit, credited back $86 of the $175, and then I was later able to get another $35 taken off. This is the second time in a week that I have checked the account before the cutoff time each night for transfers, thought the account was in good shape, only to wake up the next morning to a handful of overdraft charges. Some of these charges come from ATM withdrawals, where they could have simply refused the withdrawal if there were insufficient funds. I have researched banking law, and everything they did was legal. My complaint is that it should not be legal. I don’t feel good about entrusting my money to an entity that is using every legal means they can devise to get it away from me. I’m ready to put it under the mattress.
I lost $229 in overdraft fees that were beyond my control because the bank failed to disclose information about how debits are processed and loaned me money to cover overdrafts without my consent, at, I might add, a rate that is far beyond usurious. I would like to see a class action suit against any bank that uses high to low debit processing as not acting in good faith and protecting the assets of their customers.

On January 7th, I checked my bank balance online which gave me a positive number. On the 8th, I made a deposit for over $200. Later the same day I checked my balance online and found that I was charged three overdraft fees even though on the 7th at night, I had a positive balance. The total amount of the debits were less than thirty dollars. The charges were more than three times the amount that I had charged. I made these charges because my bank balance was positive and more than the amount that I had charged. One lady told me that as long as I deposit money, there wouldn’t be any charges while another representative told me that the bank will go back and clear debits or charges on the day that the card was used, not the day that the transactions cleared. Regardless, I’m out $105. On top of it all, I went to use my husband’s ATM card which was not a Bank of America card. I waited for the card to be returned and it was not. I then went to the teller and told her immediately. She said they do not return ATM cards from other banks. My husband then had to cancel his card and order another one. He got charged three dollars for the transaction plus a loss of the card.
I was charged $105. This charge will cause other debits to be charged against my account. This isn’t the first time. Each time I talk with a representative, they give a different story. I was also charged nearly $200 because of a bank mistake. I was returned the money however it was given to me against my account-the bank will return some items but it’s marked on my account that I made the flub not the bank. I have lost nearly $500 total from these sorts of issues.

I sent a wire transfer of $4,500.00 from Bank OF America Orlando, Florida on 10/10/2007 to Trinidad, and to this date the recipient has not received it and neither has their bank any information about the transfer. I faxed my wire transfer receipt to the bank and the recipient and confirmed all the information I gave to Bank Of America was correct, but still they have not been able to transfer the money, and the money is not in my account. This is all my savings. I have been to the branch several times, I called their wire transfer department but they are pointing fingers at each other – the wire transfer department which I called on 1-800-729-9473 said I should speak with the branch I sent the transfer from, the manager Mr Evans & the assistant manager Ms Patel is saying it is in the hands of the wire transfer department. This is very bad business, my relatives needed this money for medical costs, I have to keep chasing these people, and all I get is bad customer service and serious runaround for my own money. This transfer should have only taken approximately 3 days, it is almost a month now and nothing, can’t I get some justice here?
My relatives have still not received the money to pay their medical bills and I have no information as to where my money is.

My husband and I are traveling. We are approx 100 miles away from home. i called B of A to request an increase of the amount of money that i am allowed to withdraw from any ATM (i have done this many times in the past without problem). When I made the request via telephone with an actual person I was immediately placed on hold and subsequently disconnected. I then called back and was told that my B of A bank card hes been cancelled and there is nothing that can be done to reinstate the card and furthermore there is no possible way that I can get access to any of my money in the bank. I have called 8 or 10 different individuals at B of A including their emergency services unit and every one of them are refusing to help me get access to any of my money.
HERE IT IS, SUNDAY MORNING, AND WE ARE ABSOLUTELY STRANDED 100 MILES FROM HOME! There must be something we can do about this. This is entirely unfair. WE ARE STRANDED BECAUSE B of A MADE A SIMPLE MISTAKE. Not only are we stranded, but I also have automated withdrawals scheduled to be taken out of my B of A account from a number of different institutions and they are going to be cancelled or declined as well and I did NOT give B of A authorization to cancel my card or to do anything else with my account other than to increase my ATM withdrawal amount. I want someone at B of A, (someone who actually cares about their customers), to investigate this negligent incident and I also want an apology in writing. Otherwise, I will go to B of A and take out every dime of my money and put it into a financial institution that actually has consideration for their customers. I was charged 8 overdraft fees in one day! The policy states 5 days (so I have heard). I asked the customer service rep about the policy and he said it was 5 so he refunded me the 3 that weren’t supposed to be charged. This is computerized, right? That seems like a scam to me that if a person doesn’t know the policy then they just pay it.

They also indicated that they post the largest transactions for debit first making, in our case, 7 different $35 dollar overdraft amount. Please remember, there was plenty of money to cover all transactions in all boxes, even the amount available.
Over $500 dollars in bushwacked overdraft when plenty of our money was in their bank and all indicators of theirs said so also.

On January 18th 2008 my bankruptcy was discharged. I was then told on the phone by two senior customer service reps that I did not have to pay my loan, so I asked them to send me letters stating that. I received one letter March 12th 2008 and another March 31st 2008. The Chapter 07 bankruptcy was filed on 10/05/07, discharged on 01/18/08 and closed on 01/23/08.
I just received a letter on May 8th 2008 notifying me that Im four months and a total of $5,813.00 behind. Bank of America is now stating I need to pay to avoid repossession of my house. Im told by a representative of Bank of America that their standard answer to everyone is You do not have to repay the loan.
Bank of America told me It was include in my bankruptcy and I didnt have to repay the loan. They also failed to mention that they would repossess my house four months ago . Bank of America gave me the wrong information and should be responsible to fix the problem they caused. I dont know what to do at this point and Im afraid Im going to lose my house. Please help.

They cashed one large check so they could charge me a separate over draft fee for several very small checks. The total amount for $50 in checks was $300 in overdraft fees. That’s six times the amount of the original checks! Now they are threatening me with a collection agency!
I had to withdraw what money I had left and now stand to have my credit damaged by this bank. This should be criminal.

On 05-09-08 I orderd a stop payment on a check that I wrote completely wrong due to being in a rush that day. A few days after the transaction, the individual that i wrote the check to changed the terms of the service That I did not agree to and I decided to cancel the check. I dont understand how this individual managed to cash a check that had two different amounts on the check($100 in text and $168 in digit box)and still managed to cash the check for another amount($160)that was not written no where on the check.
When I saw the check clear I immediatly called customer service and explained my situation on 05-12-08. They heard me out and stated in a recorded call and that they understood my situation and said they would reimburse me for full amount in 24 hours. 05-15-2008. they did not reimburse for anything so i made another call to customer service this time they bombarded me with legal bank jargon and telling me to put myself in there position and to except a $60.00 reimbursment.
After a 30 min discussion about how I messed up in writting the check and how when processing my stop payment I should of stated the legal amount which is the amount you wright in text (silly me, I thought everything you wrote on a check was LEGAL). This still does not explain the negligence of BANK OF AMERICA cashing a check for amounts not written on check. What to stop them from confusing two zeros from three zeroes and blaming customers for there mistakes. On top of this whole mess The supervisor(daisy Employee#1580)decides to starts making snide remarks and when I asked to speak to manager she transfers me to some random employee’s mail box. Any information to help me resolve this matter will help. Thank you.

Their rules constantly change to benefit their pockets and there is no consistency from one rep to another. In the past year, they have managed to rob me of over $900 of my hard earned money. I only know this figure because it was thrown in my face today by a so-called customer service manager that Im doing a poor job of managing my finances. Never mind the fact that I’m a single mom and a business owner trying to keep my head above water in the mortgage industry. I have been monitoring my account on-line constantly to prevent this from happening, and no one could offer me an explanation, all I know is that in 5 minutes I racked up $210 in overdraft fees for $30 worth of transactions.
When I questioned why they process transactions from biggest to smallest instead of in the order they are presented, I was told that this was intended to benefit the consumer so the most important items are paid. OK, so if I have a $100 light bill and I go on a shopping spree for $110, how is it more important to pay the shopping spree first? They have no method as to how long credit transactions and debits show as pending before that money is out back into your balance. All they can tell you is to write down every time you use your card, and do not rely on the online banking as a ledger. I may be wrong, but I thought debit cards were created as a convenience to the consumer, and on-line accounts were an added convenience. If I have to write down each time I use my debit card, wouldn’t it be easier to write checks and have carbon copes so I can transfer it to a ledger when I have time?
Their customer service reps are rude and have no clue what they are talking about. They just love to point out that it’s your fault and they stick together like glue no matter how wrong they are. Bank of America is definitely an institution with no heart. If anyone knows of a class action lawsuit against them, I would love to voice my opinions.

I live on my disability income of $884.00 per month. The amount is directly deposited into my Bank of America account the third of each month. I have written, emailed and called the bank to tell them to cease and desist their over-draft protection several times. It has not stopped. I spoke to a supervisor today, May 12, 2008, and asked for it to stop. He told me it would. I have been told this before.
I have paid out $1716.00 in overdraft fees to Bank of America over the past year as a result of their protection. These fees have come directly out of my only source of income, my SSD check. Each month I start out in a deficit as a result of these $35.00 fees. They have charged me 5 times for one check! They will not credit my account for any of the overdraft fees even though I’ve told them to stop in writing. At this point I can’t close my account because of being overdrawn. Do I have any recourse?

Bank of America indadvertantly charged 4 overdrafts on our small business acount that had $598.27 on balance. No one at the bank could explain why. When asked to correct the problem and reimburse our account,it took 2 days to get a response. since it was not fixed immediatly, more overdrafts occured due to the first four reducing our balance by $140.00.
they fixed 6 of the overdrafts, leaving 7 more that they would not fix. The bank resident said thats all they could do and never gave an explanation as to why this happened in the first place. They,did not know why this occured, but thats all their gonna do. The bank president was not willing to find and fix or explain the problem. We have done business with this bank for years and now we can’t een get an explanation as to why these accounting problems are happening.
Besides losing money to this fradulent way ofdoing business, it has caused distress to my wife since it directly effects her small business account. Being treated rudely has its own effects resulting in more distress.

After promising me three times that I had overdraft protection on my checking account, with my American Express card, I was charged $35.00 per item, that cost $2.00 to $3.00, instead of having the promised protection kick in $25.00, which would have resulted in only one $10.00 bank charge.
On top of that, I was charged another $115.00 with no reason. I lost that money, and decided to close my account and cut my losses quietly. Today I received a letter informing me that I owed $140.00 for over a month on this closed account. I was told at the Bonney Lake Branch that there would be no charges to me and the account was shown to be zeroed out. I was told I would get a receipt but then later told I didn’t need one. Will this account closure stick?? More to follow. I’m skeptical.

the customer service at Bank of America is horrible. I called over a week ago to have one of my debit cards deactivated because my ex-boyfriend had access to it. I spent 15 mins on the phone with the rep who told me he had deactivated the card and that I could cut it up. Needless to say a week later my ex went to an ATM and toom money from my account. Of course when I called Bank of America’s customer service they didnt have a record of me asking to have my card deactivated.
Luckiely it only resulted in my losing $62 dollars. however, it should have never happen if they would have done as I asked them.

Bank of America– Predatory Banking! I have been a loyal BofA customer for more than 2 decades-it must be $ millions in transactions. All my personal finances and my families business transactions. My entire customer worth came down to a dispute with a net value of $140 dollars in unfair overage fees. At the time of my initial request, I called and spoke to several representatives who assured me that a savings account was closed and that the money had been transfered to my checking account.
I also requested that this little scam keep the change be closed on my account. (in effect, this actually was the reason that they were not able to close the savings account…or so they claim) Neither of these two things happen and I was subsequently charged 5 overdraft fees of $35 each–independent of the fact that this would be more than covered with the savings amounts that should have remained in my checking account.
I will close my account today and go with WaMu or Wells Fargo, who don’t have these charges. I simply cannot BELIEVE this crap and will take all my business elsewhere. I am willing to serve as a spokesperson against BofA as they (in the name of profit) have so eagerly/readily dismissed by business.
Consequences to me– multiple $35 charges, stress, overage fees, wasted business hours, and overall lack of respect for a long-term client.

This bank in the last two days has charged me over $320.00 in overdraft fees, the did refund me the $125.00, why would they continously approve purchases when you didn’t have enough money in your account. This bank is allowed to have this practice. I have had a pending deposit, conveniently that isn’t posted as pending but the ovedraft fees are. Then I have a transfer from my checking into my savings because there wasn’t any money left, they transferred the amount anyway and then charged me a fee.
My checkbook is now out $175.00, this is extortion.

My husband and I have 4 accounts with Bank of America…1 business checking, 1 joint personal checking, 1 savings, and 1 mortgage. Our business has been struggling, and we were 3 months behind on our business credit card payment. We received one call in March from a Bank of America employee regarding the delinquent account. We told BofA that we were working on bringing the account current. We then received a letter on April 22nd stating that we had until April 29th to bring the account current. We were diligently working on that, and my husband happened to check the business account online on the morning of April 23rd to find a zero balance. I checked our joint account, and also found a zero balance.
We went to our local branch and spoke with the branch manager, who made some calls and found out that BofA had exercised their ‘right of offset’ and emptied both accounts without notice to apply to the business credit card. The total in both accounts was more than $2100.00. The Branch Manager, Leah Goss, really went to bat for us…we were in the bank for about 3 hours, and she agreed that it wasn’t right for us to receive a letter giving us until April 29th to bring the account current, and for the bank to empty both accounts on April 23rd without even giving us a chance.
While in her office, we spoke to a representative, April Salazar, from the Bank of America Customer Assistance division, the division responsible for emptying our accounts. This person was extremely rude to us on the telephone, and said there had been numerous attempts to contact us, with no response. That is absolutely not true. We received one call, and spoke to a bank representative and explained our situation.
Yesterday, April 30th, we received a letter dated April 24, 2008 from BofA informing us that they had emptied both accounts, and that the funds would not be available as of the date of the letter, April 24th. They actually emptied the accounts on April 23rd. We certainly don’t dispute the fact they we owe them money, and we have been working very hard to get our business back on track and get the bills up to date. At this point, we are short $2100 that was to have been used to help pay those bills, along with other living expenses. My issue here is the fact that Bank of America says one thing to us in writing, that we had until April 29th to resolve our problem, then they turn around and clean out our bank accounts 6 days prior to the deadline they gave us without any notice at all. Is this legal?
We are wiped out financially. No money in the bank, no money to pay our monthly bills. Our trust in the banking system has been completely shattered and we don’t know where to turn.

Yesterday I had 4 transacations in my checking account’s pending column. 2 debits totalling -25.00 and 2 deposits totalling +30.00. i also had a balance of +24.00 from the previous day. I incurred and overdraft fee (-35.00) in the pending transctions. There is nothing wrong with my math. BOA has designed their software to this. They counted the debits first which left me with a -1.00, which never showed in the posted transactions – because it was not an actual figure – just a technical one that lasted the duration of a nano-second: the gap between posting my debits and then posting my deposits. The computer kicked in an overdraft fee, between posting debits and deposits, and then took my 30.00 deposit and applied it to the fee leaving my account a couple dollars in the negative. (amts have been rounded off to the nearest dollar)
I had transfered the -30 into my account to get gas to go to the university, where i was planning to work on a final project. I could not make it there, and did not dare buy my kids anything for supper, for fear of incurring a string of overdrafts. They ate peanut butter sandwhiches. BOA has more of my hard earned money. I plan on cutting my losses (this has happened a few times before) and leave banking accounts altogether – the conveniece is not worth the hassle. I will just work out of a cash jar, in the house, like folks use to use.

I have been a BofA customer for ten years and have never had a problem. Imagine my surprise when my check card got denied last week. I went straight to the ATM to make sure that funds were transfered from my savings to my checking. Problem solved. That night I received a notice in the mail for an insufficient fund charge.I expected that. Unfortuntely, I also received FIFTEEN more thirty five dollar fees in the next two days! They didn’t bother to decline my card until I was SEVEN HUNDRED dollars in the hole.
This, of course, was just a huge snowball effect. I never knew that I was overdrawn so they just started withdrawing hundreds of dollars out of my account. I feel like I have been robbed and there is nothing I can do about it. I have spent hours pleading my case but have gotten NOWHERE. I don’t mind paying the first couple of charges because they were my fault. But after that…They owed it to me to let me know there was a problem…At least decline my card so I could have straightened this out immediately. Please warn Debit card holders of this.
As for me….I’M NOT DONE FIGHTING!

My incident has happen three times where I have used my card or wrote out checks and had to make a deposit and made that deposit, but Bank of America moved all my transactions around.
I rececently made a deposit and knew that I had two checks that would be coming in after my deposit. Bank America credited the deposit and I got on line the next day and printed down the deposit and any previous transactions and everything was find. The following day(2 days after my depost) i get online to see what have came in and Bank America has moved my deposit around to show that in came in after my debits which of course made my account overdrawn, I called them and again they told me that they did not move anything around that it was the way they came in, and when I told them that I had copies of each and every transaction dating back three days, they told me that they move thing around because this is how the customers want it.
They want all there debits from the highest amount to the lowest amount. I said that you show debits in order of high/low does not explain why you moved my depost to be credited after my debits came in and you charged me. I’ve had it with them, I did not want to change banks because I have been with them for some time, but they have done this more than once. In my circle of friends they say they would not deal with BofA is they tried to pay them.

I checked on my BOFA checking account and noticed that my overdraft protection had been applied to +96.00. I called to ask why and I was told that pending charges and deposits no longer apply to the balance, and I had over drafted my account. NOT according to my statement. Then I was scolded by the customer service rep about not paying attention to my balance. I’ve been with BOFA for ten years, and I’ve always used the online service and cash machines with success in determining my balance.
Apparently, there’s some new rule (which I still have yet to receive a notification of) that their assessment of you balance doesn’t really matter if there are pending charges. Needless to say, I did find a sympathetic ear to transfer the $100 back onto my BOFA credit card, but I have to now call the credit card company to credit me for the $10.00 overdraft protection fee. Some racket, huh. No overdraft = $100 on my credit card, + a $10.00 fee.
I live paycheck to paycheck and I used to count on BOFA to give me proper balance information. Now I have to make sure that there’s a few hundred dollars cushion (according to the rep I spoke to), so I don’t overdraft. $10.00 fee

I am currently going through a divorce, which is expensive. Since I am also a college student and mother I don’t have a lot of money so my father very generously offered to transfer money into my account so that I could afford a lawyer. We both have Bank of America accounts and decided to go to the branch closest to my house to do the transfer in person. We assumed this would be easier and decrease the chance of there being any problems. When we transferred the money we were very specific about what money went into which account. The woman even repeated the info back to us to make sure it was correct. We were told the money was deposited and was available for immediate use since we had done all this in person (online takes longer to post). We then went to the lawyer’s office and paid by check.
I thought everything was taken care of until a week later when my lawyer’s office called me and told me that the check had bounced! BofA never emailed me or called me about this matter even though it was thousands of dollars and I am signed up for alerts when I have under $200 dollars in my account and when I overdraw. I found out at the very last minute, after I had taken off a day of work the next day to see the lawyer and talk about very critical child custody issues, that my appointment would now be cancelled, my lawyer was not reserved for me, and there wouldn’t be enough time to reschedule as she had another client pay after my check had bounced.
I called BofA and asked what had happened. Apparently the woman at the bank had transferred money into a different account despite us being very clear with her and her repeating the info out loud to us. I was also charged fees, one for bouncing a check and another for overdrawing my account. I made sure that all fees would be refunded and the money would be put into the correct account, although this was over the phone so I still had to wait 2 days before it showed up on my account. The I had to wait for BofA to email or mail me a letter of apology explaining the situation so that I could show my lawyer that I was not at fault (they refused to accept payment from me since I had already bounced a check). BofA took their sweet time with the letter of apology, which caused me to completely lose any chance of getting a lawyer at the firm in time for the court date. BofA messed a lot of things up and in the end there’s nothing I can do.
I lost a day of work (that I had taken off to meet with a lawyer) due to the check bouncing and my finding out less than 24 hours before the appt. My mother also lost a day of work because she was going to watch my daughter while I went to the appt so that I would save money on daycare expense since I wouldn’t be gone for the whole day. I was charged 2 fees (for overdraft and a bounced check). I lost my lawyer as she had to take clients who actually paid and I never offically paid due to the check bouncing. I now will have to go to a difficult custody hearing without a lawyer all because of BofA messing up!
I probably won’t lose custody of my daughter despite not having a lawyer but it has made me have to change a lot of other things such as greatly increased visitation times and much smaller amount of child support so that I have a better chance of keeping custody. If I had a lawyer I wouldn’t have made those changes. My mother is also having to take another day off work so that she can come with me to court, which she wasn’t planning on doing but since I don’t have a lawyer I don’t want to be alone in the courtroom for what I know will be a very difficult day!
Since I’m now afraid to deposit money, withdraw money, and use any money currently in the account I have been using my credit card, which I can pay easily pay off weekly when I get my paychecks since I don’t have direct deposit. It does, however, make things more difficult as I normally never use my credit card except for buying textbooks and school related supplies and now I have to be very careful keeping track of what I spent, where, when, etc. and I can’t track these purchases online as well as I could with a regular bank account. BofA is certainly not going to reimburse those kinds of things.
Even though they messed up big time and caused a lot of bad things to happen they don’t even care! I am only keeping my account open long enough to make sure that they don’t try any new stunts such as new fees. I figure I’ll wait until the next statement comes out to make sure they have everything right and then close my account.

I have been a customer of bank of America for more than 10 years. I had 3 accounts with them. 1 savings and 2 checkings I decided to purchase a house (since this is a buyer’s market) so i decided to sell one of my lands in for Florida for the down payment. I sold my land for $27,000. On january 7th I went to bank of America branch on Maryland parkway in Las Vegas with the buyer.. the buyer got a cashier’s check from Bank of America for $27,000. I then deposited that amount in my savings account.
One month went by (check cleared) and my realtor calls to let me know we are ready to cllose escrow and need the funds. I call the bank to see my balance and to my surprise on that exact same day Feb 7 they froze the $27,000. I thought this might be a mistake or just a hold so I called the customer service and was treated like a criminal, telling me I commited fraud and that the bank was coming after me .. I demanded the reason and every single time they would hang up on me… I went to one branch and again I was treated like a criminal. A day later they froze all 3 acounts with a total of $41,000. I was left with no cash and no reason why they were doing that…
I was losing my house so i went to another brach on West warm Springs. I demanded to know why my money was frozen and MYRNA one of the teller told me that I commited fraud.. I was really upset since I was loosing my house, my money and my godfather just passed away on the 8th and i had no way of going to Europe for his burial I again told the teller to call a manager or district manager but she would not do it….She only treated to call the police and when she picked up the phone to call them, i just left Bank of America froze my account for 2 weeks, sent me a check for $14000.. where is my $27,000
With all the stress I know suffer of panic attacks and am on medication. I lost $27,000 Help I need a good lawyer

I went to Macys to purchase some items on Saturday, I tried to use my debit card and it was declined. Shocked, I call Bank of America to figure out what is going on because I know I have funds available and I am automatically transferred to the Fraud Dept. in Phoenix AZ. Because I am not fluent in English, I have my granddaughter interpret for me while I am on the phone with the fraud analyst. After taking about 30 minutes into verify my information, because they insisted that they had to find an interpreter themselves and not go through my granddaughter the fraud analyst representative Cordella said my account was blocked because there was unusual activity at the beginning of this month.
The unusual activity was an atm withdrawal of $500 at the beginning of the month, which I use to pay rent. I have been doing this for the past 2 years and now they say this is unusual activity? So my granddaughter asks the rep to explain why this is happening ALL OF A sudden, and the rep’s reply was I have the authority to monitor your account, it is my job and I can put a hold on it whenever I feel like there is unusual activity. We wanted to speak with a supervisor because this person was rude, unhelpful and almost discriminating in her attitude towards us. She said I don’t have a supervisor, Im a financial analyst and I was providing you exceptional service because even though you were using profanity, I dealt with it!
And we were so astonished at her accusation because we are not the type of people to use profanity in conversations. My granddaughter was out of words and just shocked at the type of service BofA was trained to provide. She was obviously not treating me as a customer, but more of an annoyance because I could not speak English well and she wanted to get us off the phone and even denied out request to speak with a supervisor. I have never felt so discriminated by a bank employee, especially a big corp like B of A. And to think that my card can be blocked, without any reason, any time they want to… it makes me cringe to my stomach.
When I was declined of a $20 charge a Macys, I was extremely embarrassed and baffled. This is my hometown dept. store where everyone knows everyone! Who is going to pay for the embarrassment I got when my card was declined? I have a chronic cardiac disease, where if I am stressed/shocked, it could be detrimental to by survival. I had to get emergency treatment with nitroglycerine at home because I was so shocked from the situation. Also, the ruthless representative at b of A made me feel unsafe with my available funds AND was illogical in her explanations as to who this is happening. From now on, every time I use my atm card, I need to be in fear that it might be declined because someone at fraud services is having a bad day.

On April 23/2008 on my bussines account deposit the exactly amount of money to cover some payments,that shows on my online statement,since is a bussines the cards are used to fill gas on 3 vehicles,1 of this transactions never shows on the system not even as pending or -$1.00. on the balance summary. Suddenly one transaction pops up posted on 04/24/08 in the account since I got the knowledge that wasn’t enough money to covered inmediatly I run to the bank and deposit cash to prevent overdraft fees.mo mather that I complete the deposit succesfully and is posted on my account the Bank charge me overdraft fees on Previous transactions made the day before,
When i call them there answer was If i want to save money I need to have a pencil and paper and call my employes everydays and ask how much they spend on gas anyways I show them that the nigth before on the account I put the money to cover whatever shows online and they say that the transaction that they posted was there So i told them If was there i should put more money and not the exactly amount to cover the other ones. well is not the first time this happened to me on my bussines account but with the economical situation of the country and my personal finances I’m not longer willing to give my money just like that without acting,How many people is being treated like this.Is a bank entitled to make this kind of things,So why use the online banking to keep track and control if they don’t show the transactions and they later argue that is not there mistake if the computer doesn’t show it.

I would like to file a complaint on Bank of America, MYPaydayloan, MTE Financial, and Cashusanet. Bank of America has let these companies put money in my account and take money out of my account like a revolving door. I complained to Bank of America while these transactions where pending and the give the money to them. Then they credited my account for some of the transactions and then they sent that money to these payday loan companies as well. Bank of America credited my account 740.00 nsf and then debited that money back out of my account as I used a check atm withdraw. I believe that there customer service is in on this scam.
The best I can tell is that USACASHNET exists but they refuse to give me any information on the loan. They said I would have to get it on line with a user ID and password. I have never heard of these 3 companies and I can not believe that bank of America is allowed to give my money to anyone without a signed contract , without a check, and without notify me that they are giving my money to someone and then to credit my account and send it to these same people that took it to begin with is insane. I have contacted Ken Lewis, Bank of Americas President, he put a woman in charge named Leyland Southern and she claims that the bank is not in on it but she is the one that sent my money to these companies the second .
I have been refused the information from the bank to where they are sending my money and to whom they are sending it. MTE Financial does not exists at all, it appears to be an internet scam operation that changes its name quite often and appears to be in with Bank of America quite often in this scam. MYPAYDAYLOAN is suppose to have a bank account in California but there office is suppose to be in Costa Rica. How can these companies do this. I know it has to be illegal and I want my money back. I do not believe for one minute that these companies are getting by with this without bank of Americas help. I thought my money would be safe.
Is it not the law that Bank of America has to have my signature for the realize of my money to a company. I am furious. Leilani Southern refused to answer my emails and has blocked me from emailing her. Avoiding this situation will not cause it to go away. It is oblivious to me that she must be in on this as well. Anything you can do I would appreciate, I have filed complaints with the Better Business Bureau, against Cashusanet and Bank of America, how ever I can not find the addresses of the other 2 companies to file against them. MTE Financial and MYPAYDAYLOAN I believe are just bank of accounts connected with Bank of America Employees. I have also written governor Blunt and Senator McMcaskill and filed a complaint with the FDIC on Bank of America. Any information you can provide me with on these four companies would be greatly appreciated.
I am out about 1300.00, 740.00 bank fees which I was credited and then it was taken back out by Leilani Southern as atm withdraws. And the money that was credited into my account has also been given to these companies by Leilani Southern.

Everyone be aware of BOA’s new policy, that by the way I was never notified about, until I got over 200.00 dollars in over draft fees. BOA says you now have to have the funds available when you swipe your card, meaning lets say you have 10.00 in your account make a purchase for 11.00, you realize you went over and deposit or even transfer that amount from savings to checking, well that does not matter (even if the transaction is pending)you swiped the card the funds where not available so you get a 35.00 overdraft fee. Now here is the kicker a BOA says there was a survey done and majority said that they do not want things to post until midnight the following business day. Be careful how you spend your money on the weekends when items hit monday morning you have better taken in to consideration any overdraft fees you might get. With the new policy this is what happen to me.
I had 200.00 in my checking account,I spent 80.00 at one store then 122.00 at another store. Realizing I went over went directly online and transfered 70.00 from my savings to checking (before any cut off time), and was showing my available balance was now 68.00. Well now that I have an available balance I go eat and buy a couple other things not going over my now available balance of 68.00. Well come monday morning I am negative! Why well when I swiped my card the funds where not available so I received two overdraft fees for 35.00 dollars. now I still have the other purchases pending (when I swiped my card the funds where available)Since I was not charged the overdraft fees until monday these other pending purchases will now receive overdraft fees even though when I swiped my card they where available, and I’m told even if I transfer money over I will still get overdraft fees for the pending transaction because the computer system will not recognize the funds being there for these other purchases.
I thought the purchase was fine as long as the amount was available when you swipe your card? not after any fees you may or may not get. Its seems to me that polocies always change to benefit the company and never the consumer, but we are told it is for our protection or benefit(aload of you know what!).
After all was said and done I got 8 overdraft fees total. I was told that the system decisioned my fees and there was no way to refund the fees. Another load of you know what, do not ever let a bank tell you there is no way to get your money back there is always a way to override, or get your money back always! After a week of calling and going over my account with supervisor after suprvisor I did get back my fees but if I had not been persistant and almost threatning this would never had happened. Never let them take advantage of you with new polocies and procedures that never make any sense except to the bank or computer taking your money.

I have been charged overdraft banking fees to my checking account numerous times in error. The bank has acknowledged it’s mistakes but only credits me $68.00 and keep the hundreds of other dollars. My deposit dates keep getting changed, which is fraudulent which is purposely allowing the bank to make money off of me through $35 fees.
Unable to pay my mortgage, unable to buy diapers and food for my disabled boys, unable to pay for their speech, occupational and physical therapy. May lose home now that the bank has taken almost $1,000 of my money. There needs to be an investigation of this company.I made a huge mistake putting my trust and money at this financial institution.

I spoke with customer service representive about the fee they are charging me and they said they could not do anything for me due to the bankcruptsy file. Also, when I spoke with the supervisor over the phone about the problem that I was having , she said that I have to pay all the overdrawn fees no matter what the situation was. I have been a custumer since 1992 and It seems to me that they don’t care they need to rip people off no matter what.

I deposited a Federal Stimulus check into the ATM between Patterson and Turnpike with the amount of $600 on Monday June 30,2008, at approximately 2:15. I did not know when the cutoff date to collect these deposit envelopes was: 1:00 p.m. which is unusual because a normal ATM usually collects at 5:00p.m.
This resulted in Bank of America to withhold my check when funds were due to go through and pretty much said when I called the 1-800 number that night, that I only had certain funds available. If I did know this, I would not have ended up making the necessary financial decisions that I needed to do, seeing as though I figured there would not be a hold on a government issued stimulus check.
This resulted in having 4 overdraft fees of $35 a piece. I believe this is ridiculous for this bank to charge fees whenever they can. I work very hard for my money and not for the bank to charge $35 for every charge at will.

Both my personal checking and business checking accounts were closed without any notice or any explanation. The only contact number was provided is 1-xxxxxxx. This is NOT an active number, as noone eve3r answers it (even during their own stated business hours), and noone has returned any of my messages. I had the local branch supervisor look into this, and they could not get an answer either.
Other than the headaches of dealing with this, $5000+ of our cash (rent money) is no longer available to us. The letter stated that the funds will be sent out to me via mail. No time frame was given. Rent check and utility bill checks were bounced because of this (even though we had deposited cash into the account). This is absolutely ridiculous. One of the biggest banks in the county is run like a scam!

Monday, June 30, 2008 Bank Of America So here’s where the frustration begins. I have a family, Two Kids wife dog house etc… The children are of a age where mom stays home to take care of them and we have a limited income. We had a previous account at citicenz bank and just never got around to closing it. Apparently this account was over-withdrawn by a about $1.20 and reported to Chex Systems where Bank Of America took this information from the banking reporting company and froze our account. Under normal circumstances, this wouldn’t be a problem. we found out about this at Friday 8pm EST. The office that froze the account is open mon-fri 8-4. Fine, we will go the weekend without access to cash, Kids dont need food or diapers right?
Monday morning comes, I call BOA at 8:15 to resolve the issue. I was on hold until 9:45 until I hung up the phone and decided to go to the bank in person. I went to the bank where they in turn actually called the same number that I did and said I had to call Chexsystems to resolve the issue. I used the phone at the bank and called chexsystems. They told me i had to file a request for the report and it would take 5-7 business days for the report to come through the mail. I STILL HAVE NO MONEY… and the account balance is about $4500.00
So at this point the only thing i could think of is that Citicenz bank had somthing to do with this, because i still have NO information from Bank of america. Did I mention that my paycheck was directly deposited into the bank this morning. Insisting that bank of america release my funds, and they didn’t. Finally I came home and called bank of america. They at least told me that the report was from Citicenz bank and a check from BOA will be mailed to us on the 15th of july. GREAT- So how do I go about my daily life until the 15th?

i was wrongly overdrafted four (4) times through this bank. first overdraft i received was for a savings account i requested to have closed & it said on my online statement 6/26/08 insufficient funds in savings, then to be changed to overdraft item fee in which they pulled up a charge to make it seem as if i actually overdrafted & changed the date on that charge that i payed for it.
i’m fairly certain that no matter how long it is in the pending process they cannot change the date it was made on. the last three were just outrageous & they pulled up charges the same way. i will be stopping into the bank to show them proof that i placed those charges on different days in hopes to get my money back.
i lost $185.00 through their shady dealings, & subsequently cannot pay for my medications for a herniated disc in my back & for general needs. i make minimum wage, work three days a week, & they are robbing me of all my money.

I had 10 overdraft charges in 3 days. Everytime I talked to a cust. serv. rep. I would get a different story. If one was to look at my bank statement you could clearly see there were some errors made because my deposits were not showing up and the only thing that was showing was my card transactions as if were done purposely so I would get charged.
I also had a situation where made a cash deposit at the atm and the atm malfunctioned. I called customer service and they made a credit to my account and after the so called investigation they took the money back. I made several attempt to make my case but I constantly got the run around. I asked for security video to show that I made the deposit but no one wanted to help. Basically they were saying it was just my lost..too bad.

With now two separate credit cards (accounts) on consecutive occasions, Bank of America has sent out the statements so that by the time that I receive the statement I have a week to get it back to them or pay interest. This is clearly an attempt by Bank of America to: 1 – Charge interest to people who pay their balances on time, every time. 2 – Move their customers to pay immediately via electronic payment or 3 – Move their customers from credit to debit cards.
In any respect, I find this practice unconscionable and outside the bounds of the credit card agreement executed between the consumer and Bank of America. I am put in position to pay usury interest rates on a credit card on which I pay the entire balance via US mail within 24 hours of my receipt of their statement.

I feel that it’s one of the worst banks you could possibly do business with. I’ve been a customer with them for 5 years, and they recently charged me over $700 in overdraft fees in one day. Apparently I had pending transactions that went though which over-drafted my account. On the day this happened, I was using my debit card all day in the subway ($2 a pop) with no knowledge I was over-drafted, and they were letting the transactions go through. They charged ($35) every time I used the card, which at the end of the day, for about 40$ in transactions, they charged me over $700 in overdraft fees.
I had plenty of money in my savings account and credit card to cover the overdrafts, but they made no effort to cover me, or alert me that I was over-drafting. When I called to ask about at least getting some of it refunded, they treated me like sh*t and said there was nothing they could do. Now, $700 isn’t a crazy amount of money, but the fact of the matter is, they’re scam artists. What other company do you know of that is allowed to charge roughly 170.5% interest on borrowing money ($700 they charged % $40 I borrowed.) There are laws against this kind of thing, but apparently there is no law governing how much a bank can charge in overdraft fees.
I feel as though there should be more laws written on banking practices. I take the blame for not balancing my checkbook as well as I should have, but I’m outraged at the penalties banks charge people for this, it’s a legal form of robbery. It seems all I can do now is spread the word!
Wasn’t able to pay half my rent this month, had to borrow money, at interest, putting me further in the red.

They placed a 2 week hold on a payroll check that I deposited by ATM. I have direct deposit, from the same company, that goes into my account every other week. This specific check was a bonus and without mentioning the hold by email or mail or phone, the bank placed a hold from 6/16/08-7/2/2008. I thought that I had money, and used my debit card for $1.61 coffee’s and $2.00 parking fees.
In addition, I have written checks and made payments online and almost everything has been returned or will be returned. I have tried to contact the bank by phone and email, no one is willing to explain why this has happened. To make matters worse, the fees they are charging me are $35.00 each, plus all the fees that the merchants have/are going to charge me.
I already have over $460 in fees now! I am a single parent and I live in a very expensive region of CA, I’m not even going to have gas to get to work or have food to eat. I am afraid that when I get paid on 6/27, they will eat up my entire pay check in fees!

I have over draft protection on my checking account at their bank. How it works is when i overdraft it automatically charges my credit card $100 and it deposits into my checking so i never go negative. I went on vacation at the end of march to early april and I was using my debit card with no problem and no worries. I get back from vacation and deposit a $300 check into my account and I see that my account was $650 negative. This was a sunday night I had to get back to school that night.
So the following weekend i went to the bank on a saturday, and spoke with Ed. He said yeah i don’t know why you were charged, he called the main office and the person on the phone said I shouldn’t of been charged either. Ed said i was going to get my money back and he would give me a call on monday. Ed never gave me a call. I went back into the back a couple of weeks later. The women I spoke with wouldn’t even talk to me she said Ed would give me a call he never did again. I went to a different location to talk with a different representative. She could not give me any answers either and said she would call me. She never called me either.
I went back to Ed. He said I payed a credit card payment late and that automatically unlinks the overdraft protection. I was never told that I didn’t have protection anymore. I was never asked if I wanted to relink it after I payed. After my vacation I was left to live on my credit card. I had $350 in my savings and they took the money out of my savings and put it in my checking to pay off the balance with out me knowing it. This bank is wrong and cost me a lot of money and debt. Also if my account was over drawn why would it let me keep using it to rack up $650 that should not be allowed especially if i was unaware.
I have had to live on my credit card while away at school. I lost $650 dollars, and suffered extreme embarrasment.

i had a bofa checking account my daughter stole some of my checks and preceeded to write out and cash them i paid off the checks as they came in i cntacted bofa and told them and ask them to close out the account from nov of 07 and up through april of 2008 they would still allowing hte checks to come thru so they could charge overdrafts fees, and they didnt close out the account till 01/08
they now have me in same claims court for overdrafts fees in the amount of 1945.03 even tho i had called them over and over and ask them why they were charging me overdrafts fees on stolen checks and why they were allowing those checks to run thru 3,4, and 5 times each. every csr i talked to could not give me a reason why all they would ever say it is your account and you are liable for it even tho i had ask months beofre to have it closed out and reported the checks as stolen, they would not and had not recorded the checking account as stolen
now i will have to pay all those charges plus maybe criminal charges due to their neglengence

I recently moved to Salt Lake City, UT where Bank of America does not have a physical bank location. Since my checks get direct deposited anyway, I chose to keep my BoA account open but for the few occasions I have a paper deposit, I have to mail it in. I fedexed a deposit and waited for it to show up in my account. It showed up as pending and I used my debit card. However, the still showed as pending the next day but my charges cleared.
Since I made the assumption the pending deposit would clear, I won’t beef about it being held longer. HOWEVER, even without the deposit, I still had $47 + change in my account. My debit card charges were $29 + change and $20 + change respectively. Only ONE of those charges would have caused an overdraft but they charged me $70 in OD fees for both?
The CSR told me that they sent out an account update in December stating the change in the fees policy. Now they will charge fees for all debits they process the same day if the account goes into the negative. I asked the CRS you mean, even if one of the charges doesn’t cause the account to go negative, I get a fee because both charges were processed the same day? She said yes. HUH?

We have been a long time commercial customer of Bank Of America. We utilize our debit/checkcard to provide payment to our vendors daily for work that they do for us. There can be as many as 20 transactions in a day authorized by our vendors to our card. During the day and evening the transaction will be sitting as ‘pending’ in the online bank statement we can review. Often Bank Of America will allow the bank account balance to go into the red for pending transactions. Normally we will transfer funds to cover these pending which automatically removes them from the red or negative status prior to posting with a date.
Occasionally, during the month we may miss doing this by 12 midnight and a pending goes to posted with a date. This would show up as a ‘red’ negative to the account in the dated transaction section. We are in agreement with the bank that once the pending goes to a dated red negative it is an overdraft. In the month of May, on one day, 10 of these pendings went to red negative dated. Therefore we expected a $350.00 overdraft fee for this error, as has happened in the past. We agree it was an oversite. We have never been charged overdraft fees for pending items that did not move to the section with a date. As long as we cover the pending before they moved to an item with a date we were fine. For two years we worked under this premise and were charge minor monthly fees for a small amount of overdrafts that slipt by.
Today we were debited $3300.00 in overdraft fees which were ACHed out of our operating account without notification prior. Of course it put our account in the negative which we had to cover to avoid problems. Our Accouting/Office Manager reviewed the transaction in May and could only locate the 10 overdraft items we anticipated on the statement. All other pending items that appeared negative were covered before the posted with a date. Bank Of America is now claiming that they consider there to be 90 overdraft items for the month! Although we only see 10.
We spoke with our bank assistant Shasha out of Point Pleasant, NJ. She indicated that she could prove 90 overdrafts and would fax over verification immediately. She has not done so as of yet. We tried to explain to her that we have not changed the way we cover our pending transactions and that we only saw 10 overdrafts. She rudely insisted we were wrong, and that their banking practices and rules had not recently changed, although it appears that they are now charging us $35.00 for ‘pending’ transaction that go in the red even if we cover them before they date.
We have just been charged 10 times the normal fee we would expect. We are at a loss as to how to handle this situation. We feel that Bank Of America played it underhanded by changing the overdraft rules mid-year to get funds and fees from our account on transactions we never were charged on for two years. Just when we feel that we have learned the rules of Bank Of America they change them to invoke more fees.
Our corporation lost over $3000 in revenue because of Bank Of America’s trickery, and stand to lose another $3000 next month because we no longer have a handle on their rules and the games they play. If they can not prove 90 valid overdraft transactions according to the rules we have abided by for over two years, I am considering contacting my corporate attorney.

I reported a check fraud on my checking account on Jun 10. The bank helped with getting my money back and said that if I would like to put a security hold on my account then I can call back and do this. I did call back and asked that they do the security hold, they put the hold on my debit card. 2 days later the same check fraud came through taking more money from my account, and caused anover draft.
I called the bank but they said they would not help me becasuse I did not put the security hold on the account. I explained to them that I did put the hold on there, but the guy from there bank put it on my debit card instead of my checking account. They said that they would NOT help me, and I would have to pay the fraud check and 3 35.00 fess that they were putting on my account for the over drafts. I did what they told me. The guy at their bank screwed up and now I have to pay the price.
I now have to pay the fraud people and the bank their fees.

Four overdraft fees that should not have occurred. Our register and the on-line statement provided by BofA agreed. However; the statement that BofA uses (that we, the customer do not see as verified during a telephone conversation on Feb 13th) did not agree. Basically, BofA said we made a $44.33 mistake. When asked to show us the mistake they (Ms. Carpenter a supervisor at BofA) could not show the mistake. I told her I disputed the fees and wanted a refund. She said no, it was our mistake but could not or would not prove it to us.
This has happened several times. I want everyone to know two things. 1. The on-line statement is not trustworthy unless it benefits BofA. 2. If this happens to you PLEASE FILE A COMPLAINT WITH THE OCC!(Office of the Comptroller) When I asked the BofA rep where I could file a complaint she suggested the in-house BofA complaint procedure and the BBB! When I asked her about the OCC she said she haad never heard of them!
I am diabetic. As a result of this creative manipulation of our account I was unable to get my perscription filled so I am out of medicine tonight, tomorrow and well, until we get enough money to cover these incorrect overdraft fees and I am unable to purchase any groceries. I informed the BofA supervisor (Ms. Carpenter) of this but she didn’t care.

Bank of America set up a fee system that’s just dirty. Used to be when your balance was at zero you’d be denied. I assumed that was the case. I moved my savings out of checkings and overdrew on my account. They charged me 25 to 35 per debit that i charged after I hit zero. It came out to about 300 dollars. 25 dollar fee every time i put a coffee on my debit on the way to work. It’s criminal.

I had a cashier’s check to cash that i was weary about and explained this to the staff when i arrived. I asked them how long it takes for one to clear and they told me that is takes two days tops and i got the check cashed and waited. I waited the two day they told me and went back to the same bank to make sure that the check had cleared. I specifically informed management again that i was unsure and that was the reason i was checking.
They told me in these exact words that there was no hold on my account and that the check was good and it cleared. Still insistent there could be a problem later i held onto the money for another two to three weeks to make sure that everything was fine. Figuring it was a cashier’s check it should be almost fool proof, waiting the two days they told me, going back to make sure there was no hold, and still waiting three weeks before i touched the money; i figured that it was okay to disperse it like i had planned.
Then a little over a week later, June 6th, i my statement makes me aware that the money was charged back to me stating that they were not able to collect on it. After explaining the case again to bank manager they are claiming they have no responsibility for the other bank sending the check back late, because they are suppose to send back with in two weeks if it is no good, and then telling me they don’t know why they could not get payment. I don’t see how a large branch like bank of america cannot tell me within three weeks that a cashier’s check for 3,950 is no good.
I am upset that the bank claims no responsibilty even after i took every precaution to make sure this would not come back to me. I am appauled that after i explained my suspician they didn’t tell me to wait at least a month to be sure. I felt that they didn’t bother listening to me and are so quick to say that they are not responsible. I told them from the get go that i do not have the funds to back up this check and that is why i am checking to make sure it has cleared. They actually thanked me for coming in to take that extra step and i again told them this has to be clear and that they are certain. Two associates, one being a manager checked and promised me that it was fine. And now they are charging me back this money and are not trying to pursue the bank that authorized the check.
This has created the biggest strain ever on both my family and my relationships. THey are refusing to temporarily freeze my account and waive any overdraft charges. This will hurt my credit because i don’t know how or when i can pay this back even though i feel it is mistake on the bank’s part that lead us here, and it is the bank’s because of the promised i received amd the precautions i took. I just bought i ring for my girlfriend hours before i found this out and what should be one of the happiest days in my life has turned into one of despair and hardship. This problem with the bank has caused me severe depression and anxiety and i feel that life can not be good or the same for a very long time without some serious help

BofA closed my business account to further charges based on information we obtained from your account, as well as from information reported by a major credit reporting agency. I was not, and am not, in default on the account, or on any credit card account I have. Due to a late payment, perhaps two, over a period of two years or so, my interest rate at the time they closed off further charges was 19.24 on purchases and 23.24 on cash advances. Kind of high, but I have other credit, and I decided just to pay the monthly bills and not complain, which I have done, regularly, on time.
Yesterday, I received an amendment notice stating they’re raising my interest rate to 27.99 — not based on anything related to the closed account but again on information in the credit reporting agencies files. According to the BofA representative I talked to on the telephone just now, the increase is because they have determined I’m a risk. (My credit score does not bear this out.) I can’t close the account to stop the increase (it’s already closed). After years of suspicion that BOA was ripping my wife and I off, the last straw has landed. On March 24, 2008 my wife and i purchased a trip package to cancun. The airline tickets were charged seperatley from the hotel package through Expedia. The next morning while checking my accounts i noticed that i had been charged for 4 tickets. Not 2 tickets as actually selected. Under further investigation we noticed that there were actually 2 sets of transaction #’s. one for my ticket and one for my wifes ticket, then the exact charges including Transaction # were Duplicated.
On top of that we were slammed with 150.00 worth of overcharge fees because that action as well as other banking actions had sent my account spiraling into the negatives. after some phone calls with some not so willing staff, we were givin a credit to make up everything. then 3 weeks later the amount of one of the tickets was STOLEN from my account by Bank of America. This being a holiday weekend of course we recieved a letter saying that the airline had declined any wrong doing. with little time and a hot head attempted to contact bank of america and like so many other people encountered BOA staff that was rude and discourtious.
this is know in the third month of this So Called investigation. I have since closed all my accounts except the one under contention. BUT i Will NOT GO AWAY. I work hard for my money and i am not going to let some bank who thinks that they are above the law. this is my money and they made a mistake and know they dont want to play by the rules and give me my money back. this has gone past the point of being reconciled. I want to be compensated for my troubles.

i had purchased a money order from money gram that had been stolen and wrongfully cashed by b o a. the money order has sent 2 demand letters to b o a and they have yet to respond. i would like to know why and when they will get this taken vare of.
i am still fighting eviction from my apartment complex becouse this was my jan rent. someone was arrested and will be sentenced for this crime this month. i would just like to get this money back so i can resolve this situation.

On May 20th, I checked my account online and had a balance of $8.54. I had my husband deposit $100 at 8:32am and another $351.36 at 10:16am. My husband asked the teller to cash and deposit the checks. This is documented on his deposit slips, which we have a copy of. The teller did not cash and deposit them, but simply deposited them, therefore BOA put a hold on the deposits until 5/22.
When I checked our account that evening online at 5:02pm, we were negative $118 dollars because they posted five pending transactions from 5/19 AFTER our deposit.
We called and talked to customer service at 5:10pm and she said that it was the tellers mistake because she did not cash and then deposit our checks as we specified. She said that there were not any overdraft fees and that we could go in the next morning to the bank and they would fix the problem. She recorded this in her notes. I checked the account a final time at 6:47pm and we were now negative $293!! They charged us $175 in overdraft fees after we had deposited $450 that morning!
The bank manager would not help us and continued to place the blame on us and not the teller! They also insulted me by claiming that I was not one of their premier customers so they would not refund me the fees! I have deposited over $40,000 with them since January! Just what does it take to be a premier customer!?

I travel all over the world and do not like to carry large amounts of cash but prefer to use my ATM card in the country I visit. I notify B of A before leaving to let them know that I’ll be traveling to other countries and using my card so I don’t have an issue. I went to China this week and used my ATM card with no problem.
I tried to use my ATM card again and found that it was blocked. I sent emails to B of A customer service and they told me the only way to unblock the card was to call a phone number in Atlanta. I told them that I had no phone and could not call. After 5 more emails, they still gave me the standard answer that I had to call to have it unblocked. Not sure why since I had to use a password, answer a secret question, and then confirm a site key before even sending an email. What’s the point.
Needless to say their customer service rep’s, all in India, did nothing but say they can sympathize with me. Not sure how since they were not stranded in China.

We became 3 months behind on our business loan with BofA. We have been customers of BofA since 1987. Without a warning they ZERO’ed out our checking account $ 5978.21–wiped us out. We had been struggling to keep up with payments and also had a debt consolidating firm assisting us. This was devastating, financially. It was immpossible to get someone one the phone(in our panic) and then were told debt offset. We feel this was an unauthorized debit–STOLEN FROM US–with no one would reverse. (we would have paid the 3 month back debt…)This completely broke our trust in this firm.
All our monthly automatic withdrawals bounced–adding further to our economic hardship–rent payment was not there, as well as the monthly allowances for food, gas, transportation, medications, etc.

I borrowed 15,000.00 in a school loan from a reputable bank (NOT Bank of America) and it was addressed to myself and my grandfather (co-signer). As I have been depositing large amounts for the last few years as my school loan checks come in I did not worry about depositing my 15,000.00 check into the ATM. This was a big mistake! Because this particular check was addressed to myself AND my grandfather they said they could not accept it. However, this was after they put the full 15,000.00 into my account which I saw through my online banking webpage the day following the deposit and I started writing checks to pay tuition, rent, etc. This amount was not in the pending section it was in my account, all 15,000.00.
Therefore, I wrote all these checks and was using my debit card only to find out a week later that had pulled the whole 15,000.00 check out and began docking me 25.00 overdraft fees and then 35.00 overdraft fees, and then 35.00 NSF fees for all my checks that began to bounce. In the mean time I had just closed my campus mailbox where BofA was sending all my banking mail (and lots of other things were being sent there also) and was in the process of updating my address with all of these companies. So when BofA went to return the check, they sent it to my closed campus mailbox thus leaving me with no choice but to wait for my check to make its way back through the post office so I could add my grandfather’s name to my account and get that check deposited back into my account.
Okay, what my problem with BofA is: They put the whole 15,000.00 into my account leading me to believe that I was safe to write checks and pay my bills with my student loan check and then later that day they took the full amoutn out without notifying me directly. If they discover that one or more of the payees of a check isn’t on the account after they have deposited the check in full amount into your account, they need to notify you directly not through snail mail which in my case got sent to a closed campus box leading me to accrue unnecessary bank fees.
To date, BofA has charged me 511.00 in both overdraft fees and NSF check refund fees. I spoke with Charles Lee at the Alta Loma brach where I originally opened my account four years ago and he assured me these fees would be taken off. He gave me a card with a Customer Solutions Center’s phone number on it and told me to call and they would take care of the fees. He even said he put a note into the system about me calling. However, upon calling today the Customer Solutions representative I spoke to refused to refund the fees and when I asked to speak to his manager he would not let me stating, This is the highest your call can be escalted to. I have since tried to contact Mr. Lee but surprise, surprise the number he gave me to reach him is out of service.
Because of Bank of America’s hugely unfriendly staff, unhelpful customer service representatives, and poor communication with me I have had to go 2 whole weeks without any money, use 511.00 of my school loan money to pay BofA fees, wait two weeks for the check they sent to my closed campus box to make its way back to me when I would have come to the branch to pick it up had they called me (you know, it being such a large amount), I had my school threaten to kick me from my summer school courses because the check I had originally wrote them after double checking that the money was in my account bounced, and my reputation is ruined with them. In addition, my grandfather has had to take off of work just to come to the bank with me to put his name on my account and because they treated me with such little respect I had to bring an older man just to get them to give me any real answers. Answers that in the end, got me nowhere.

These guys charged me four hundred and fifty-eight dollars in overdraft fees. I thought I had 1.50 in the bank when I made a two hundred dollar deposit. Essentially, what did happen, was I was charged overdraft fees on transactions in my account when those same transactions showed up in the black on online banking after making a two hundred dollar deposit a week before the two hundred dollar deposit already referenced above. Given that I can count to two hundred and I thought I had two hundred in my account I spent it, unaware that I had three fees charged to earlier overdrafts that originally showed up in the black on my account the previous day. My spending two hundred, while I actually had 95.00 dollars after they charged the fees, I ended up with more overdrafts. I got some action after complaining relentlessly.
Iif I continue to bank at BOA, I am self diagonosing me as officially out of my mind. Therefore I’m closing my account today.

I have a joint CITI credit card with my aunt. Citi sends me checks to do with what I want. The credit limit is $28,000+ with a cash advance limit of $15,000. This account has been perfect for 4 years. As I needed funds I would deposit these checks from a stub pad. The stub had the date of expiration but not the check. One time I realized I deposited a check with the expiration expired. Citi cashed it and said I had this opportunity till the end of 2008. When I received the next batch of checks I was going to make a deposit so I removed the check from the dated stub. But I didn’t use it then. A couple of weeks later I needed funds and used the check I had removed from the stub pad. I deposited the check and the next day withdrew the funds. Unnotified to either me or the primary cosigner Citi refused the outdated check. Now my record will indicate I have done this numerous times before and almost always withdrew the funds the next day. It’s common sense, when your take advances you need the money so why is it fraud to remove it right away.
So BofA closed my account but oddly accepted a wire transfer from the same institution that previously denied to cash my check. Now BofA has me on chex systems and is in possession of my $600 wire @ over 20% interest since May 9 2008 and I have no access to funds I must repay at a high interest rate.Now I receive a statement from BofA that I got debitted $35 for a bounced check and $60 for account review. BofA asked me to confirm by notary that my cosigner of the Citicard knew of my transactions. My aunt did so immediately and verified that I have full authorithy to do as I wish. This was faxed with receipt on May 9 2008. After countless follow ups all I get is rude hangups or it’s under review. What is to review. I proved it’s no fraud and have a history of these transactions. All this happened because I mistakenly depostited an advance check that was expired and these checks have no expiration date only the stub does.
Now I am barred from opening amy account because BofA reported fraud to chexsystems. My cosigner who by notary confirmed she was aware and consented to my transactions was rudely hungup on by the agency that requested proof that no fraud was committed. Without a checking account I now must use money orders at a cost to me and not have access to direct deposit of my income pay. I don’t blame suspicion by BofA but I have given them all they asked for to clear my name. Why didn’t BofA contact me via my cell they have my number. Why wasn’t my cosigner contacted via Citi?
Cost of money orders, delayed access to biweekly pay because of no account for direct depsoit. Loss of $100 for opening chase account with direct deposit due to chexsystems. Telephone correspondance waiting on hold for countless minutes while being rudely hungup on. The cost of my wire advance of $600 since 5/09/2008 without access and the cost of $60 review. My gas to go to differebt branches of BofA and time off from work. My emotionly state has caused depression, my erratic behavior by missing work almost to lose my job. My nerves have tensed everytime I see a BofA ad or branch. I have lost hours of sleep trying to figure out how to resolve my conviction and sentence by BofA without a trial.

My son and I have a checking account together, we opened it in 2004, we also had a truck loan with this bank which we recently paid off in the amount of $8,000.00 Know that this is a small town maybe 8,000 people my son was born and raised her we have lived here for 30 years everyoine know who we are and that we are not going anywhere and that we are hard workers and pay our bills..so..we deposited a $2,800.00 by ATM on a Sun. afternoon a receipt came out and told us the balance in our account was 3,400.00 we then withdrew $100 cash a receipt came out and told us we now had $3300.00
two days later we paid some bills eleven all told those checks were returned NSF, not sufficent funds, why we asked the banker oh he said a hold had been placed on that check why we asked the banker, well he said you have been overdrawn several times..why weren’t we notified we asked well he said when you opened the account, 4 years ago, they told you banking policies, I don’t think so and where is the customer relations pick up the phone NSF was a lie the money was in the bank

I was charged 5 overdraft fees of $35 each on 5/19/08. My account was overdrawn by $6.81 by their own records on that date. The way they stacked the charges, the last two of $15 & $4 overdrew the account by the $6.81. I have not disputed the $70 in fees. However, many customer service reps and a phone supervisor later, we are still going around and around over 3 charges which left the account still at a positive balance. They claim that another automated charge caused it – but yet that charge went in 2 days later- causing it’s own fees. How can I be charged 3 x $35 for charges they show leaving a positive account?
$105 extra in overdraft fees.

I am complaining about the way that Bank of America’s (BOA)accounting practices. I have a fixed income that is a direct deposit to BOA monthly. When my balance gets low, they will rearrange the incoming transactions and place the larger ones in from so that my account will go into the negative. Then they do not pay the check but at first glance make it look as though the check is being paid. When you go to view the screen again the transactions have been completely rearranged and your balances are different again. This is a way for them the rack up on a lot of extra fees.
They also will hold transactions and not post them until your balance is low and you wonder where the transaction came from. Sometimes the transaction is over three weeks old. I want nothing to do with their banking system and I am in the process of changing to another bank.
As a result when I get my monthly income I am not able to pay my bills because they have taken it all. My mortgage and utilities are in jeopardy because of this. It is not fair!

I use B of A’s Privacy Assist Service, which gives me information on my credit activity, for $9.99 per month. I have recieved a letter from Bank of America informing me that I will automatically be upgraded to their new Premier Service at month-end, and the charge will increase to $12.99 per month. If the consumer does not want the service, he is given an 888 phone number to call to decline.
I have had to call twice, the first time getting cut off without speaking to anyone after five minutes on hold, the second time on hold for over 35 minutes and counting (I am on hold right now as I wait for an answer). I plan to cancel this service, if only Bank of America will answer my call.

Just incurred over $140 in overdraft fees because BofA rearranged my purchases, payments and deposits to their liking so they could charge me 4 overdraft fees. Customer service tried to explain and did not make sense and just back peddled. I bank online, so basically keep any record by online banking is pointless. They have done this to me time and time again and I am tired of it!
Over $140 in overdraft fees-now have a negative $140 balance in checking account when it should be at $0.

For many years I’ve used BofA for both business and personal banking. For many years I have fought with them over fees and unexplained charges, overcharges, and lost deposits. I have had many fees reversed.
I’ve spent over $10,000 in fees – much of that was reversed due to bank errors, but much of it was paid by me. Along with merchant fees. Yesterday, I was charged three NSF fees when PENDING charges hit my account. The reps can’t tell me why all three were charged fees – because two totaled far less than the balance of my account. One was for more. I’m not sure how they got three fees, but get this – today I got charged another NSF fee when the actual charge hit (yeah, the one that was pending before is now a real charge and since the three NSFs from the day before overdrew the account, this incurred two more nsfs.
How can they charge me twice for the same debit ? (They told me the original ‘auth’ was the ‘charge’ and that I had committed funds to that once I made the purchase, but how then can they ding me again when the charge actually ‘hits’ the account? This is a very expensive snowball affect. PLEASE – LET’S CLASS ACTION

I have had an ongoing problem w/BOA for the last 4 months or so. They have taken over $500 of my hard earned money, and now are stiffing me on a charge that wasn’t even mine. They have a habit of taking one or two overdrawn items, even as small as a dollar or two each, and ending up with 5, 6, 7, or more overdraft charges by adding the OD charges in as far back down the line of paid charges as they can.
Example: two weeks ago I forgot about a 15 dollar gas purchase, and ended up going overdrawn on three other charges. I noticed while doing my online banking and went to the ATM, adding enough to cover all but one payment of $14. I was expecting a fifty dollar negative balance from this. However, they went down into the Cleared part of their listing…things that are supposed to have already been paid, and according to the businesses, had been…..and began adding charges. By the time it was all over, I was around $250 overdrawn!
I called and yelled at them for stealing my money, and the manager kindly cut half the charges, leaving a $130 deficit – better than nothing. What really got to me was her telling me that yes, the online site says Cleared, but THAT ISN’T NECESSARILY TRUE!
Before that, a charge from Sirius Radio came through (I don’t have and never have had that service) and caused $210 overdrawn charges. I disputed it, had the charges reversed, and then sent in a form they sent me to sign. A couple weeks later I got a notice saying they never received it, so I filled out the replacement they sent and mailed it the next day. Checked my balance on the day my check was autodeposited, and found the charges had been reinstated. Tried to call, got no one. Sent a message through their website. Tried several more times to call, finally went through the regular number and had myself connected manually by them. The guy I spoke with checked it out, saw that the deadline on the second form was 8/19/08, and it had come in and been scanned into the system on 8/18/08. Thinking all was cleared, I breathed a sigh of relief.
Next day got an answer back from my online query telling me there was a deadline, it may not have been met, and even if I reopened it, THE CHARGES WOULD REMAIN ON MY ACCOUNT EVEN IF I WERE PROVEN TO BE RIGHT! How can they do this? They are outright stealing from me, have been for several months, and I can’t do a thing about it. I know when something is overdrawn I will get the $35 charge for it, but how can they then add that charge in several paid transactions earlier than it occurred, driving more payments overdrawn, adding more charges, driving more payments overdrawn?
I am disabled, trying to live on a fixed income, and working toward becoming self-sustaining with my new job. However, these people are driving me further into debt by causing me to be unable to pay the bills I have to pay to survive and keep working because I keep having 2 to 3 hundred dollar debits before my next check comes in. It simply isn’t fair, and something should be done.

Bank of America scams people out of their money with their Outrageous overdraft fees. I checked my account at 3am (I have a new baby and am up all hours of the night) and my automatic deposit was pending for today’s date. No other pending transactions, just the deposit. At 9am, two checks were overdrawn that had today’s date. Now, at 3am, they were NOT pending, nothing, but at 9am they have went through, bounced, and claimed to have went through on yesterday’s date.
How could this be? The one check was for $5.00 and one for $150, and I had over $100 in the account, and of course, they put the $150 through first, so they could charge me two overdraft fees. Something else that I have noticed.. Checks, debit transactions, credit transactions and deposits will pend for a day, sometimes two to three days, but when you don’t have enough in the account, the bounced transactions NEVER pend. They go through IMMEDIATELY.
If I didn’t have my mortgage, equity loan and all of my checks automatically deposited into this bank, I would change banks. But, I feel like I’m stuck. They have probably taken over a thousand dollars from our family in the last several years just from overdraft fees.

This Bank [takes] enormas overdraft fees by moving charges around so they can overdraw your account, overdrawing your accounts for pended charges and then you find the charges reversed to positive the next day, charging $35.00 for overdrafts for charges amounting to $8.48, choosing to assess charges that will net them for example 5 or 6 $35.00 overdraft fees when they should be no more than one.
However, their customer service department claims they pay the largest ones first as a service to the customer. How is that a service when all are paid by the bank, large or small? It is a method they are using to excessively charge your account. One day a charge is posted, the next day it isn’t.
I’ve made a cash deposit when a charge is pending. They claim they instituted a new policy that does not count the cash deposit immediately, thus when the posted the pended charges, they did not account for the deposit until have the pended charges posted and took all my money in overdraft fees.

The bank charges a future 35.00 debit hold to the account on two transactions (70.00), which nets the account negative due to the deduction of the charge before the debit. Customer no service states that the online banking is just a tool, if the transactions show pending it is not accurate. When I use their tool they provide to me I expect it to be accurate and up to date.
Overdrawn on account, which would not have happened had their fee(s) not be deducted before the charge was not pendng to the account.

When opening my checking accounts, I had a check card / ATM card ordered, linking my checking accounts for transactions to include: Point of Sale Merchant puchases, online purchases, ATM withdrawals, etc. There is an option that the bank offers that you may have your card shut off when reaching a zero balance. I WAS NOT MADE AWARE OF THIS upon opening my account.
My deposit agreement does not state anything as such in its Agreement. My account went to zero and I was unaware and went about making purchases, not knowing that the Bank was paying the point of sale purchases and on top of that, charging me $35.00 per point of sale purchase. How are banks able to legally get away with stealing your money, and they NEVER made you aware in the first place that you could have your card shut down when you reach zero? Please advise.
In debt approximately $1,000.00 to the bank. I had a direct deposit go into one of the accounts on Tues., August 12, 2008 and all the bank fees were automatically deducted away from me.

Apparently BOA has a policy of deducting debits of the same day in order of largest to smallest amount and not in the chronological order it occurred. Meaning if you have a $105.00 available balance and you make 10 $1.00 purchases in the morning and later in the afternoon you make another purchase for $100.00 you will be charged 5 overdraft fees (They deduct the $100.00 first and then ten times $1.00)! That would result in $165.00 for an actual $5.00 overdraft of one transaction.
I have been told by customer service that this is BOA policy and there is nothing they can or will do about that.
In my actual case it resulted in $140.00 overdraft charges due to this policy!

I have 6 transactions posting on my account without my consent. I admit they were my fault because I signed for loans this month- since I didn’t get my check yet. When you sign for loans, they pass your info on to third parties, but I didn’t see in the fine print that they can charge your account without you signing anything. I am 27 and very smart.. I know that you have to agree with THAT person with paper work or verbally to allow money from your bank account.
I spoke to Bank of America over 2 hours, which consisted of being transferred 9 times to customer service, to fraud, to claims, to customer service, to fraud, so on and so forth. Usually Bank of America helps me out. I would talk to claims, and they send paper work, I sign and send it back, or customer service are smart enough to see a fruad and they credit it back. Well, not this time. I asked to speak to the supervisors, and they’re not clear as to why they can’t help me. The last supervisor I spoke to, Dan from Claims department, said well when you sign for payday loans you’re agreeing to allow third parties to debit your account for their services.
I have had to use payday loan companies for valid reasons, and I’ve never had that happen to me until now. He sounded careless and not eager to help me. He said that there was no way they can help because I gave my consent through a contract- which he hasn’t seen, nor does he know which payday loan companies I have dealt with. So now I am stuck with my money being taken away- no phone number for these companies provided. I want my money back and somebody needs to help me.
I have over six 35 dollar returned item/overdraft fees posted to my account because of these unauthorized transactions. I am negative 91 dollars and will be more by tomorrow, the 14th of August 2008 because of another transaction coming through, that I did not authorize. I am not rich, but I am not a fraud. I don’t want to be penalized for someting that is not my fault.

A year ago my wife applied for a loan on my behalf. When talking to BOA representative on the phone she was (verbally)assured that the interest rate will be 7.99% FOR THE LIFE OF THE LOAN! I made payments since day one and out of the blue, the last statement which I got a week ago, showed an interest rate of 15.99%! When I called them to find out what had happened they claimed that the 7.99% rate was a promotional for ONE YEAR.
Loss of over $1000 in added interest rate fees.

This is my second bad experience w/ bank of america. I deposited $300 via ATM. However, I am not sure if I miss keyed and entered just $200 or the ATM made a mistake but my balance only shows $200. I contacted customer service and explained the situation. The associate told me that if there is an outbalance in the ATM, you will get your $100 the next business day. So i thought everything was solved out. The next week I checked in there was no change. I filed a claim and after theire INTIMATE RESEARCH, they found nothing at all!!
Now I am filing another claim and reopening the case. How ridiculous is this that we have to fight for our own money?? How can I be so sure that my money is not going to disappear out of my own bank account? This is such a big waste of my time. I have to keep calling them and waste my minutes. And neither is there an instant reply. Their automated service take FOREVER and does not enter things correctly!! I mean are there people working on this or what?

i paid my bill in full , and now i am owed a refund of 283.41 they said it would take 7 to 14 days and now it is august 11 and still no refund check i have talked to tyhem at least 3 times and they keep giving me the run around. they say they have to wait for the billing cycle to end i dont understand why. when the account was closed for 4 years so nothing can be charged anyway italked to many people there. today they said it would be a few more week s before they can reissue acheck they never issued in the first place. please help if u can
this money could be in my bank account making interest not in there account. imade good on my half by paying in full now they should keep there half of the deal

I filed an Affidavit confirming that U.S.Cellular placed unauthorized charges on my account. Bank of America had returned two of the three payments on 7/29/08. On 8/05/08, U.S. Cellular resubmitted payments and they again were withdrawn from my account. When I asked Bank of America why they allowed the payments to be resubmitted even after I have a signed affidavit stating these are erroneous charges, they claim that they cannot stop them and because they are still investigating the claim, they was nothing they could do.
Bank of America claims to offer security protection, yet even after following the necessary steps to resolve this problem; the payments were paid in full, from my account. In the end I had to borrow money from my parents so that I could be there for the surgery that my father was having. Although Bank of America and U.S. Cellular were aware of the problems they were creating, there seem to be nothing they could do.
I soon could be loosing much more then money since the total of unauthorized charges were $551.09. I am sure there will be nothing they can do about that either. I will be closing my accounts with Bank of America, and stay away from both U.S. Cellular and Bank of America.
Over $551.09 has been withdrawn from my account. Many other bills are being place on hold. Closing of the accounts means changing deposits and scheduled bills to a new bank. All of which takes time. The worse part of it was the rude, shameful treatment from both of these companies. Bank of America’s rude remarks Were not letting them do anything, yet U.S.Cellular has received all three payments in full.

I purchase a 4-wheeler through Bank of America. They were the financual lender with the dealship. After paying for the item in full. In 2005. Come 2008, they claim they can’t find record of payments. Although payments were made by money orders to Bank of America and a couple of cash pymts to Bank of America in Champaign,Ill. The Bank of America can’t find my account nor payments made, but can find my date of purchase, now image that! You can track and find a purchase date, but no payments and your going to wait three years to find out why payments haven’t been made and not send any letters or repo the item?
Then the Bank turns this over to a collect agency and they are threatening to take me to court for the amount. In the meantime, this was purchased for my son his senior year in highschool. Immediately after highschool he join the active army. I sold the 4-wheelere and gave the title and registion papers to the purchaser. And threw away the loan papers now how do I prove payment of. Or do I have to pay for this item again?

I have two checking accounts with BOA, a CampusEdge checking account and a regular checking account. I use the student checking account for my finances and the regular account for Ebay purposes. I have been transferring money from one account to the other to take care of ebay expenses. About a month ago I went to the bank and deposited money into my student checking account. I use the online banking website, so later that evening I accessed my account, confirmed the money was in the account and proceeded to make three seperate transfers into my other checking account for ebay expenses.
The next day I had three overdraft fees ontop of what I had transferred due to the fact the deposit was posted after I made the three transfers…I have one question…How could I possibly transfer money that was not even in my accont? I can’t seem to come up with a good answer and neither could the representative I talked to from BOA. When I called to find an resolution to my problem, I was a little disturbed that they could not verify my account. In the past I have called the bank many times and had never had a problem. I am not sure how my information got confused, but this was a big inconvenience.
After going through a hassle and finally using a different method to verify my account, I was told I would have to go into an actual banking center to fix the situation that I did not take part in messing up in the first place. When we finally discussed the actual problem of my overdraft fees I was made to feel that it was my fault although they did not give me a good explanation of why I was charged the overdraft fees. I was told I would be reimbursed one of the overdrafts as a courtesy but that was all they could do. I was very dissatisfied with the customer service.
On another occasion, which was very recent I made a deposit on a vacation home in Florida for $261.29. After I booked the vacation home I checked my account and confirmed that they had debited my account for that amount, which indeed they did. The next day, I did a routine check of my balance and noticed I had more money than I expected. When I accessed my account online the vacation home deposit was not there at all when I am 100% certain it was there the day before. I contacted the business in which I had booked my reservation with and they confirmed that my reservation went through and the deposit was paid.
I have no explanation as to why that debit has disappeared off of my account activity but luckily I am keeping track of this activity better than BOA is or they would have another reason to charge me another overdraft fee. I honestly feel it is a disgrace when you feel that you can’t trust your bank, I have been with this bank for a long time, but now I feel that I am going to have to bank elsewhere. I am no longer able to afford to have an account with these people.
For the three overdrafts I was charged I was reimbursed for two of them, which I was pleased about, however, I didn’t see how it was my fault to begin with so I really shouldn’t have had any. I am taking this as an economic loss along with the many other overdrafts I have been charged in the past due to the way they post transactions. I have not yet gotten to the root of the problem regarding my reservation deposit.

I attempted to close my bank of america checking and savings accounts. It takes hours to get a person on the phone. I finally did. I sent several email messages regarding this with responses. I wrote a check to myself to get both accounts to $0 exactly, and then they contacted me and said I couldn’t close the account because I was .97 under. They waited until I hit 0 and then did a keep the change transfer of .97 cents and then charged my savings account for being at 0, which was what they told me it needed to be in order to close the account. This was after I had notified the bank in writing and on the phone for over two weeks that I wanted to close down the account. Kevin, a supervisor who refused to give me his last name, said they wanted to charge me all these over fees for being at $0 but he was going to be nice enough, so as to not charge me.
THey wouldn’t let me pay the .97 cents to close out over the phone. They said I had to send a check, because I am not in a state that doesn’t have bank of america. i asked him if he could promise me that once again if I got it down to $0 by sending the check in the mail, if he could promise me that they wouldn’t do it again (charage me fees for being at $0) and he said no. I have checked online and this seems to be a common occurence with other Bank of America customers. I do not care about the 97 cents, but the behavior is very unethical and this disturbs me even more so because it seems systemic.
Countless hours on the phone. It is very difficult to get a person on the phone. And sometimes they just hang up on me. Stress. Anger. feelings I am powerless and being manipulated. Worried about my credit score.

I have been a customer of Bank of America’s for a number of years. Recently, I began incurring overdraft protection just prior to every paycheck period. I wasn’t doing anything any differently. I don’t keep a register… I log on on a regular basis to check my balance and spend money accordingly. I went into a branch a couple of weeks ago to ask a CSR to explain which transactions were causing the overdrafts and low and behold, when she pulled up her system, it’s completely different than what the online customer sees. The online transactions are apparently not in chronological order so the customer is not able to determine what caused the overdraft.
For example, I logged on on Thursday (8/7/08) evening and viewed a number of pending transactions. The ending balance, including these pending transactions, was 300-something dollars. In addition, I was to receive a paycheck via direct deposit Thursday night (as has been done for years). I woke up Friday to see plenty of money in my account – more than enough to cover all transactions – right along with a $100 overdraft. How could I have possibly incurred an overdraft with a $300 balance AND a $1200+ paycheck that posted sometime during the night? As a matter of fact, looking at the way items posted to my account today (Fri, 8/8/08), the balance that’s posted just prior to the overdraft transaction is $1814.07. The balance jumped up to $1914.07 after the overdraft. Now, how is that fair to me that I can’t even determine when or why that overdraft kicked in? It’s not! It makes absolutely no sense and someone should do something about the way BOA is conducting their business.
Since my overdraft is hooked up to my BOA credit card, the bank charges 10% with each overdraft, even if I immediately transfer the money back to the credit card. I still can’t figure out which transaction caused the overdraft. In this particular instance, I did notice that one of my mortgage payments was suddenly posted to my account even though it NEVER appeared in the pending transactions. How can this be legal, ethical, accurate or fair to the customer?
In addition to owing money and fees to the credit card and bank, and in addition to the frustration, the consequence is that BOA is making millions off their customers’ lack of understanding on how they’re conducting their business. They’re relying on the fact that people can’t see what’s really going on in their system. It’s unethical.

I have a complaint. I have both worked for and been a customer of Bank of America. Now, the problem I have is that on two occassions in the last year I have had a debit on my account that I was not aware of at the time. The first was because of a double refund from fraud on my account, that account was closed and a new account opened. The second debit, I am still waiting for word from the bank as to why.
On both occassions the first word I get of a problem is a call from SRA a Collection Agency. In this last instance I went directly to the bank to find out why I had a debit as my final statement said zero. It has teken them over 4 days to get an answer for which I am still waiting. I then had a confrontation with the SRA representive who called me a liar and threatend my credit. Told me it was my fault that I had ignored bank letters. This is unacceptable, I would accept that in the first instance that I might have over looked Bank notification, but not twice in less than 8 months.
When I tried to contact someone about calling off the collection agency I was told they can not do that till the debit is paid. I pay my debits and all I want is proper notification and proof of the debit. Instead I get the run around and told there is nothing anyone can do…..this again is unacceptable….if you can start a collection then you sure can stop one. I do not like being treated as if I am a criminal and trying to defraud the bank. I would welcome a call from the President of the bank to explain the banks position.
I remember once the President of the bank came to the call center where I worked and said Bank of America had gained 3 million customers this year after the cheers died down he said we also lost 3 million customers. I am one of those lost customers and I represent at least 50 other people in my large and extended family that I will make my mission to never use BoA. I will from this point on be a vocal advocate against BoA. Lets see if you can suprise me; will I get a call from someone high enough up the food chain to make a difference? I am a little pessimistic.
Right now it is just time. However my credit is being threatened and I am being labeled a liar. I have spent over 32 hours trying to resolve this.

False information given to me re: Credit Protection Plus program. Cancelled over the phone on multiple occasions but fees kept accruing. Wrote 2 letters, one to general statement address & then to actual CFO of corporate. Asked to be refunded for total amount charged plus interest due to fraud. Refunded partial amount only.
Corporate (which was just another call center) would not listen to my concerns when I explained the logic of why I would pay an additional $200.00 a month plus finance charges on top of already high balance when I couldn’t afford my payments as they were, yet I had continued to pay. Obviously I would not agree to such a ludicrous set up had I been given the full story up front of the charges.
Currently earning under $900.00 per month and unable to pay for services I cancelled multiple times.

I deposited $150 into my savings account via ATM. It reflected in the account the next day. However, after 2 days my account showed $150 missing out of the ATM because the money wasn’t found. So now that money is missing out of my account. If they could not tell the difference between CASH and ENVELOPE, why have such service? How can we be guranteed and satisfied that next time we make a deposit our money will be safe?
It is more of a mental damage and waste of my minutes that I have to constantly call for assitance. Plus, they take forever to answer. How can this bank be trusted?

I use them because I have to but in actuality they are costing me a fortune that I cannot afford. The first few years that I would call to inquire about the overdraft fees and the rearrangement of purchases on my account, I was treated like I was crazy and given the runaround. Sometimes I was told I would receive a callback in which I never received, ever.
Finally, this year I am told that the charges are placed in order from largest to smallest at the days end, due to customer complaints in the past concerning nonpayment due to insufficient funds on items such as a mortgage payment that customers preferred to have paid as a priority as opposed to a smaller charge on their account for that day. I disagree and was told that process was soon to change due to increased customer complaints. The next call I made in reference to overdraft fees, I was told that was indeed NOT true and was not going to happen. Wonderful, back to the old routine of me being crazy again.
I have also sent many e-mail correspondences in hopes of a more accurate solution or answer to my problems. This too never happens. I get basic replies to do not solve my problem and usually do not answer my question. It’s like they pretend I am asking something different than what I am. I have placed several request for the total amount paid from my account to the bank for overdraft fee charges each year that I have held my current checking account active. Each and every time I get I would be happy to assist you with your request……then all I get is instructions on how to view my account, which I already know how to do. I believe it is over $5,000. per year, this is absurd. No matter what I do there seems to be a loop hole that sucks out the fees.
My consequences are being BROKE most of the time. Having utilities cut off. Not having Christmas or food money, that is in my account but I can’t access any of it. They placed a fraud alert on my account because of increased spending the day prior to Christmas Eve. Not having all of my house payment because they charged me 5 overdraft fees in a day. Not having what I need when I need it for my children.

Okay, last week, I completed an application to open a new Bank Of America MyAccess Checking account. I already had 2 other checking accounts with them, along with a savings account and credit card. Well, anyways, I completed the application for the new account and set the openeing deposit up to be taken out of my current checking account, the amount was supposed to be $40.00. A few days later, I log into my account and see that the new account is open and has a balance of $4000.00. My original checking account had a balance of $59.00.
I called the 800 number and the rep. told me that it was a coding error. They had taken $3,400.00 off of my credit card and $560.00 out of my other checking account. She said she would fix it, she left $40.00 in the new account and transferred all the money, which was $3,960 back to the original checking account and then she transferred ALL of the $3,960.00 back to the credit card when she was only supposed to transfer $3,400.00. I lost $560.00 to the credit card.
I have called in and have spoken with several reps that claim that nothing can be done and the other half of the reps tell me they will correct it and note it in the account. I called today, the guy says there is no record of anyone doing anything and that I can’t get the $560.00 back. I dont’ know what else to do?
I’ve lost $560.00 of my money.

I have been calling Bank of America to cancel my Credit Protecion Plus Since i did not approve or gave the ok. I just relised it when i kept getting an over the limit charge. Not only that, Even with auto pay and them getting their money monthly the closed my account and stated that i had to much debt. i have called several times and e-maild them only to be told the same thing. call the 1-800. i will be taking to a lawyer to see what can be done.
Over the limit charge and had my credit cards closed for to much debt.

At end of business day on 7/29/08, we had a $6.24 balance in our checking account. On 7/30, and not until mid-afternoon, (2) $35 charges appeared on the website againt the account. When I called to inquire, I was told by a BOA customer service agent that these were (2) overdraft fees for activity on 7/29. How could that be possible I asked if I had a $6.42 balance at the end of day on 7/29? The agent said that BOA now includes any pending transactions even though they have not posted to the account. How is that possible or legel for that matter?
Bottom line is, the transactions were never processed and were still pending as of 7/30. The agent explained that letters were sent out by the bank to inform customers. What difference does that make? I don’t believe what they are doing is legal or is an ethical business practice. How can I manage my account? Additionally, I knew our account was very low and had checked it several times that day. I had asked my husband not to use the ATM card for anything until my paycheck deposited on Wednesday. The last time I checked it, INCLUDING pending transactions, there were a balance of over $10.
Even so, the bank website itself shows our balance above zero. How can we be charged $70 for overdraft fees if the bank has not yet paid on that transaction? Something is not right with that. Unfortunately, I do not have any screen prints from 7.29 but I do have screen prints now showing a positive balance on that day.
Economic damage is that we have been unfairly charged $70 when we still had a positive balance in our checking account.

I opened a CD account online four days ago on BofA’s website. I have been a customer of BofA since 1970. I have two savings and two checking accounts, plus a mortgage. The CD was to be funded from money on deposit in one of the BofA savings accounts. Because my credit report is locked (per California law) the bank wouldn’t open the CD. It is locked because I receive as many as fifty credit offers a month.
Other than the hastle of changing banks, I wasted many hours trying to resolve the issue. It is also possible that they offered a high rate CD and realized it was a mistake, so they found a reason to not issue a CD, because the higher rate is no longer available.

Long story short, FIVE times within a course of one year cash deposits have gone ‘unregistered’…not showing on account after physically walking into the bank and dealing with a teller NOT an ATM. Of course.. the cash showed up immediately as available that day..a day or two later the deposit isn’t even listed on the statement or recorded anywhere. THANK GOD for holding onto receipts.
I will be pulling my account with them shortly! I have been with BOA since United Jersey…then summit. Since the early 90’s. Almost two decades. And this is how I’m treated? Needless to say, I have called the OCC and am waiting for papers to file an official complaint and an investigation will be done.
I really rather not mention the headaches this has caused… in having to straighten out NSF fees as they seem to be popular in doing.. Bottom line.. Something fishy is going on at BOA.. so let’s all file an official complaint and show them we, as long time consumers, will no longer tolerate their misappropriation of our funds.

Customer service online for Bank of America charged me for overdraft fees of $35 for NSF when my account was not NSF. I checked my account on 7/21 online at 11PM and nothing was pending against the account and I had a positive balance. I checked again on 7/22 and nothing was showing pending online again with a positive balance. On 7/22 at 1PM I deposited a check for $600 and my account did not show overdraft in fact funds of $100 were available to withdrawl had I wanted to withdrawl. BofA is playing games to get NSF fees that they are not entitled to have.

I feel that overall, Bank of America is a lousy bank. I used to deposit my payroll check into my checking account. I wasn’t notified that it was put on hold until I got a little card from Bank of America notifying me the following week that my payroll check would be put on hold because the bank that handled my payroll was out of state. During my hold time, I would use my debit card and my online balance would be in black with a positive balance. After my check would be released, I would find myself paying for a few overdraft fees and I would also find those transactions with totally different numbers than the day before.
I signed up for a savings account and also the Keep the Change fund. Sometimes the change coming out of my account will be two to three dollars sometimes it will actually be the change. So why are there such differences? I had also signed up for overdraft protection. The bank manager in my area had suggested that I transfer 25.00 from my checking to my savings at the first of each month. He told me to try it out. So I tried it out and I wasn’t thrilled with it only because the first of the month is financially difficult for me and $25.00 can either make me or break me.
I called the 1800 number and spoke with someone and told them that I either wanted to change the date-which I could not or I wanted to cancel. She informed me that I would have to keep a daily balance of over $100 or else I would incur fees. She said basically the auto-transfer was protecting me from the fees. I was furious. I asked her why I had not been informed of this and was told to try it out? She said sorry but was condescending and rude as 98% of Bank of America customer service reps are. Bank of America also allows customers to use their bank cards even when they have a negative balance so as to rack up all of those overdraft fees. BoA is awful.
When I lived in Kentucky I delt with a local bank. I was never in the red nor did I have all these ridiculous fees. As soon as I am able to open an account at a local bank and transfer my bill pay and accounts to it, I will promptly close my BoA accounts. I am worried though, I have heard that even when people close accounts, they recieve fees with little explanation.
In the two years that I have been a customer with Bank of America I have paid over $1400 in fees. Many of them I have contested for being double fees on one transaction or for putting my payroll check on hold. Just for examples. My family and I live pay check to pay check. My husband and I are both students. When I’m hit with five or six overdraft fees, that’s food that is taken away from my kids.

On Thursday July 17th I withdrew $7000.00 from a savings acct I had with WAMU to cover excessive expenses we were incurring. I had them give me a cashiers check so that the funds would be available immediately. On Friday(18th) I went to BofA to deposit it. I was told because I had been previously overdrawn (at the time of the deposit I was not) that a 10 day hold must be placed on $2000.00. I said that’s ridiculous I deposited CASH. I was told they had to go by what the computer said, oh well call customer service.
I went home and called customer service and they told me to take it up with the bank itself, they had the ability to fix it. Now where am I? Waiting for a response (I’m told don’t worry the money is available on the 29th) and not able to pay bills. I e-mailed the corporate office and have had no reply. They tell me they have a right to make a judgement call with my money since it’s in their bank. WOW!
I’m sitting here with a $1000.00 bill due today (22nd) unable to pay it, unable to get food and gas and no money until Thursday (24th) yet I have $2000.00 sitting unavailable.

On Thurs 7/17 Bank of America put a hold on my accounts. I contacted there Customer Service Dep’t immediately, I spoke to Rep Yencia stating that she had no information as to why my account was frozen. She gave me the number to Risk Closure. I contacted them on Fri 7/18 after 9:25am and i spoke to rep Derry who refused to give me the reason as to why my account was on hold. She stated that I would be sent to Check systems and there is an investigation going on and it will be 7-10 days before I would get an answer.
After battling for 20mins to get some answers she still refused to tell me! She said my accounts would be closed out as of 8/1/08 and I will get my money in a cashier’s check along with a letter. I went to the Windy Hill, Smyrna Bank of America Branch and spoke to Jose Argumento on Fri 7/18 around 2pm e/t and again he could not give me answer as to why my account was on hold. Again I spoke to Derry in Risk Closure and still refused to tell me what the situation was.
My accounts were current and not overwithdrawn. I have not wrote any bad checks. The last check i wrote was to my car insurance company in March 08 and that cleared. I don’t understand it. I have been inconvienced, I had no money for gas, food or other necessities for the entire weekend. I had to leave my job early on Fri 7/18 and loose 4hours of work. I hope that my complaint will be reviewed and I can gain some justification.

I wired $4000 to an account in trying to buy a truck that turned out to be a fraud transaction. Bank of America had frozen the account and assured me that my money was safe. I was told the account was under investigation. A few weeks later I find out that the account had been zeroed out by Bank of America and they don’t want to return my money. The person with the fraud didn’t get my money. Bank of America has my money.

It occurred June 4, 2008. The case has been investigated by several bank reps, but no results yet. I call and call but I keep getting put off. What can I do and who can I call to get this resolved and get my $1,000 back? Thank you.

BA routinely shows unauthorized withdrawals and misc random charges of unknown origin. Sometimes these are pending charges that never get posted, sometimes they do. 2 weeks ago was the worst; I had well over $300+ in multiple charges of unknown and unauthorized origin that put my account into a overdraft. The Overdraft was not real, only pending if/when the charges actually posted.
In Multiple email inquiries BA said that I could not contest pending charges but wait until they posted, then complain and my account would be frozen pending investigation. The spurious overdraft blocked my access to my own money prior to an international trip. AND it also generated 2 separate $35 overdraft charges. The unathorized charges were never posted but the overdraft charges were and they stole $70 from me (this time) and are very rude and unhelpful when I try to complain about it. This is the latest example of a routine business practice by BA

On the 14th I had some transactions posted on my account that showed pending and I was -$25+. My grandfather posted $200 cash in the bank at 11:30 AM. My account showed a $35 fee and $127 balance left. By 2:00 PM on the 14th my account reflected -$27. By the 16th with no other transaction, I am negative -$147. The details are as follow. The online transactions show I had a negative transaction of -$0.87 before posting. (how this changed, I have no idea) After various transactions showed as pending I had $127 left right before Noon. By 2:00 PM my account was -$27. Fees of $35 x 5 showed up and they still had transactions that had cleared show as pending. T
he transactions show they tried to take money from savings which had $0 so to cover the -$0.87 and charged me $35 for trying to take it out and not having the money and then another $10 for the transaction fee. So, by the time the $200 was deposited I was negative -$10.87. Once money was deposited I guess they decided to take 5 x $35 fee, clearing a few transactions (all under $20) and now today, charging me over $300 total and my account balance being -$147 with still 6 transactions pending. I added up all my debit transactions and they don’t even total $100 dollars.
So, Bofa has ripped me off again. I am closing my account and leaving it negative. I really believe they have people monitoring and changing transactions because at every 2 hours of the day and/or by the next day, the transactions are completely different. I only make $9 an hour and work part time. Of course customer service tells me it’s not a Bank Error. SInce when do you get charged fee’s first, make you negative and then have all your transactions bounce and get charged more fees? Especially fees form the bank trying to transfer money from my savings when they can clearly see I had no money in it. This is fraud and I’m not sure how they are continuously able to get away with it.
On 7/14 when my grandfather deposited the $200 I was stranded at work with a negative balance of -$25+. By the time I tried to withdraw (when I got a ride)I was -$27 and $200 had been used for the fees. My mother had to Western Union me some money. Today, after not having used my card because I was negative-$27 I am -$147+. That means the $100 my mom direct deposits into my accuont will go to fees and still they show transaction from 7/13 as pending so they can charge me more.

I have been a Bank of America customer for years. I received the worst customer service from any business today in years from Bank of America. The agent named Elaine I talked to at 7.00pm kept inturpting me, was rude, sarcastic and racist. When I said I wanted to close my account due to this and wanted to talk to a manager, she refused. She said Oh, you only want to close your account because you did not like my answer, not because of the customer service.
When I demanded I wanted to speak with a manager, she said if you want to, fine, but you have to be on hold for 30 minutes! When I called back and talked to Ron Redford and asked him to close my account and told him what happened, he did not offer any apologies either. He said he can close my account immediately and send me a check, but no manager will call me back after I close the account because I am no longer their customer. Worst customer service ever! I will make sure all my scheduled bills are paid, this is reported to the Consumer Affairs and then close my account.

I too am a victim of Bank of America’s NSF Fee program. I have been hit three times this year. Just this week I was hit with 5 NSF fees. I had a positive balance on 7/14/08. This included the pending transactions that were already deducted. The items fell off and as of today, 7/16/08 I am showing $210.00 of overdraft fees! I have spoke to representatives all three times as to why is the bank charging for transactions when funds were available but showed pending payment status. No one could come up with an accurate answer. I have been asked repeatedly if I have been educated in how to avoid overdraft fees. They only credited me back two overdraft fees this year and refused to credit me back in this weeks fees. They are simply horrendously wrong.
I work two jobs in the effort to get out of debt and here is a bank who professes themself to be a peoples bank, who is putting countless of people in debt. I demanded for Bank of America to close my two accounts and they refuse. I am very concerned of what other fees they will try to apply while I am trying to gather the money to pay the current incorrect NSF fees that they have applied. I am totally disgusted with this institution.

I recently found that Bank of America has been making automatic deductions from my checking account at Community First Credit Union in Santa Rosa in the amount of $200 a month. I called my bank and asked where they were sending the money as I have nothing to do with Bank of America. They tried to find out from Bank of America but they would not tell my bank anything because they were not the customer.
So I called and they could find no account with my Social Security number on it and not one with my husband’s on it so we are not customers and they will not tell us anything. I spent the whole day talking to different people who said this to me and dealing with the other people who assured that it was the other bank’s problem and I should deal with them. Run around from everyone. Bank of America has $2400 of my money and will not tell me where it is and how I can get it back.
I went to the doctor today because my blood pressure is way too high because of this. I want my $2400 back and I want to know how they got my money in the first place.

Upon looking at my son’s account on July 8th, 2008, we noticed he was hit with 5 NSF fees, when only being in the negative for 3 purchases. Come to find out they say they have changed the rules on pending tranactions, which means, that if you have a transaction for example: on the 2nd and it is showing it is pending, and make a deposit on the 3rd before it hard posts, bringing your balance to a positive balance, you will still get hit with a $35.00 nsf fee.
He was in a positive balance on the 8th, 3 transaction hit his account, but he was still in a positive balance, but since they were from the 6th, and he was negative on the 6th he was hit with more nsf fees. They don’t go by the balance of the day it hit, they go by the balance of the day of the transaction, even if the item falls off for a couple of days showing your in a positive balance and then reappears and your still in a positive balance you will still be charged. The notice states their rules have changed, but it does not state that they go by the balance of the date of the actual transaction and not by the current balance of the day the transaction actually hits. Is this legal?
Was hit with over 300.00 in nsf fees, even though he was in a positive balance when the items hit.

Bank of America has been automatically transferring $200/month from my checking account in Community First Credit Union to some account they have. I have tried to find out what this account is so that I can get my money back, but Bank of America says that they do not have a record of me or my husband having any account when they search by social security numbers. They then refuse to tell me where they have been sending the money.
Both banks insist that it is the other bank’s problem. Bank of America refuses to give my bank any information because they are not the customer and they refuse me any information because they do not have an account for me.
Bank of America has $2,400 of mine and I want it back. There is also tons of emotional stress and upset and wasted time around the issue.

I scheduled an online payment for $866.81 to my electric company. I spoke with my electric company they could not wait two day for the payment so I stop the online payment and paid them cash. The online payment still was process but return due to insuffient funds. I reponded to the via email and telehone call. After nine diffrent people, 10+ diffrent emails they claim the can not fund a process payment.
How can a stopped payment, then NFS three times then emails telephone calls which transfer you to the wrong departments still gets processed after you deposited money in your account 10 days later. I have written check against that money which now bank of america is not processing including the rent. This is not the first time I have had problems like this with them.

On Friday Sept. 19th I had a total of $589 in an account with BOA. On that same day I made debits in the amount of $9.20 on the 20th I made debits in the amt of $94.96 and on the 21st i made debits in the amt. of $214.07 for a total of $318.23, which would leave me with a balance of $270. Now on Monday I made 2 debits, 1 for $234 and a second for $117, which would put me in the negative and an overdraft of $35 which this was done by accident. Now what BOA did was even thought those 2 debits were done on the 22nd BOA posted those 2 transaction first because according the rep. they post the largest amt. first so my debit of $4.18 on the 19th was posted last because it was the smallest amt.
Now Im well aware that because of the lack of funds for the last transaction of $117 that was made on the 22nd, I am responsible for the $35 which is still not justified. But because of their action I now have a total overdraft of $175.00. I call and spoke to a rep who told me that the charges were valid and that she could not do anything about it. I then asked to speak to her supervisor and the supervisor who even though both agree that the method can be seen as unjust still refuse to credit my account, she says the fee are correct and thats all she was willing to credit.
Unfortunately for me, I have direct deposit from my job on this account so as soon as my money hits the account theirs will be taken out first; even thought in this case I may spend $200 which would be greater than $175 and would totally contradict what they say. Can any one help me this is a huge blow to my pocket book especially in these times?
I usually pay my child daycare every two when I get my salary now with a pending debit I have no idea how my childs daycare will be paid for.

I over drew my account 1.75 on Monday night and 100.00 was deposited over Monday night to Tuesday morning. I was still charge 33.00 a full day after. The fee was not accessed and updated until late in the day after I made an ATM W\D 80.00 Tuesday morning. The fee was not reflected on the automated teller nor the online banking site or I wouldn’t have withdrawn. It said I had a balance available as though the 100.00 deposite had covered the 1.75 overnight.
On Wednesday I checked the onlne sight and decided to call and check to make sure all was well. It wasn’t, I was informed that another 33.00 would be assessed on Thursday because my 80.00 ATM W\D on Tuesday morning coupled with the 33.00 NSF fee assessment caused a -14.75. The online banking site says that I have an available balance of 14.75 no negtaive 14.75.
Now I will have to find a way somehow to get the rest of my rent money together becuase Bank of America has swiped 66.00 dollars to compensate the 1.75 overdraft. I’m 66.00 short on the rent.

I am upset because for the BILLIONTH time I’m calling Bank of America to talk to them about current overdrafting fees. I made two purchases and one withdrawl on friday (one of them was my lunch run) and then saturday I made a few more purchases. I lost my debit card on Saturday and had to order a new one. So come Monday, I go to the bank to withdraw money so I can pay bills. So I withdraw $230 on Monday during my lunch (12-1pm). I leave $5 dollars in my bank account. I check my account today because I wanted to make sure nothing overdrafted, and guess what, IT DID! I saw several 2 dollar charges done by my bank that eventually overdraft me.
If you use atm machines at the gas stations or even grocery stores, not only does the machine charge you a fee ranging from $1.50-$3.00 but the bank also charges $2.00 per transaction at a nonBOA machine. This must be a new fee for them, because when I opened the acount two years ago, I was never assessed these fees. No one told me about these changes either. So I have three random $2.00 charges that I didn’t even know about. So that’s the first issue.
The second complaint is the way that they clear transactions. I understand that they clear transactions based on largest to smallest but I had no idea that they don’t take into account. So what they did is after I withdrew money from my bank account on Monday at 12:30pm when the banks are open, they cleared that first. Then they started taking the two dollars away from withdrawing money from a nonBOA account (mind you ontop of the two dollars I agreed to pay when I took money from the machine). So they took all transactions for Friday – Monday and posted them from biggest to smallest. I was on the phone for thirty minutes with Desiree, the supervisor, asking them why they don’t take into account the dates and she tells me that the consumers voted on the way it should be done. I told her I never voted for this policy and that I didn’t understand why they would group FOUR days worth of transaction into one day. I told them I felt that this was a way to make money off already tight consumers. I said that this policy creates optimum cash flow for the bank while leaving us wondering how we’re going to make ends meet.
I informed them that my boyfriend had spent the past three months correcting the damage the bank has done because of their policy. I agreed that they should post biggest to smallest but that they NEED to take into account dates. I informed them of the trouble that Wells Fargo has gotten in for these practices. This didn’t worry her at all even when I started listing various law suits that BOA had been involved in. I told Desire that our country was in a midst of economic crisis and all your policies do is protect the bank. I told her that the bank is capitolizing on every opportunity to charge their consumers money and to make money for the banks.
Because of this I’m going to be out $100 bucks. I’m a full time employee and part time college student, so even the loss of $100 bucks coming from this weeks paycheck is a serious detrement.

Have had over a thousand dollars in over drafts with bank America. They showed the credits and on the account. Then when My house payment came in. They took all the credits out! And bounced everyone but the house payment.At a fee of $35.00 each. This happened two months in a row. There accounting is a hole new type of accounting. Never have I seen such do as we please action. No wounder they can bail out other institution for billions of dollars. They are taking money with out even doing a robbery. In there eyes anyway. In mine is the same as stealing.
They told me under the new banking law they can do this because there has been so many foreclosed houses. If they had just done the house payment. There would have only been a $35.00 over draft. Lucky there was not another recite come in or they would have bounced the house payment because of over drafts.
As a result of this my family has suffered hard ship to recover from their actions. Something should be able to be done with this banks way of doing things.

I know about overdraft fees and how ridiculous they can be. Labor day weekend, I had 12 transactions that I was absoloutly certain I had money to back them up. 3 days before any of those were done, my paycheck was directly deposited. Online it reflected that it had been cleared. However, after making those purchases, the following Tuesday I checked my account to find 12 overdraft fees. I checked my personal ledger to the online ledger to find many problems on their end. Not only to they prioritize transactions as a customer courtesy but they also didn’t clear my check until Tuesday morning.
First and foremost, when I make a transaction, I never spend what I don’t have. If the bank says my deposit is clear, I go forth accordingly. But coming back 4 days later and saying it had not, and then charging me 12 times, is uncalled for. I went to the bank with my ledger and the online ledger to argue the fees, to get a rude and disrespectful teller tell me, Ma’am your history reflects 6 months ago that you had many fees charged, and all of them you felt were not accurate. Well first off, 6 months ago is ancient history, I’m talking about the past 4 days.
Secondly, what purpose does that serve searching my history 6 months ago, and how does that aide in my recent complaint? Yes, I had mistakes back then, but that sure as heck doesn’t dictate how I got 12 OD fees, NONE of which I was to blame. BOA decided that I was at fault for these fees, and would not (not even after speaking with 3 supervisors) refund my account any of the fees. I even pleaded saying that was MY ENTIRE check for child support, and that I would not see a dime of it now.
Single mom of 2, I NEED IT. BOA could care less. They are a monopoly bank with very little concern to their customers. They want your money, not only to hold onto, but also to keep. I have closed all my accounts, withdrawn all CD’S and Mutual Funds, not to mention had the majority of my family do the same. I’m from a LARGE family, that’s a huge hit.
I’d say 30+ family and freinds withdrew their accounts in all forms. When you have well-off family… you are talking quite a few million dollars lost to BOA.

This makes me subject to late fees and a raise in my interest rate. They have also made it impossible to reach some one to talk about my account and the terms of my account. Bank of america has charged me for over five times a fee of $ 35 for overdrafts. I checked on my account on the 15 th of Sept 2008 and everything balanced fine but I knew i had made some checks so I made a deposit on the 15 th at about 10 P.m. On the 16 th of sept 2008 I checked on my account and saw that my check was pending as well as other transactions. On the receipt for the deposit it clearly show that funds will be available on the 16th. On the 17 th when I checked my account again I found that they had back dated about 4 transactions for 15th of sept 2008 the day I had checked and everything was OK to have me go into overdrafts, that really hurt.
I called the girls that if what I see online is not accurate why do I need to see it anyway? If they do as they say that they are the peoples bank why can’t they feel the same way we do and not charge for trasactions that didn’t show when we access our accounts? Isn’t only fair that both parties should be as transparent to each other so all of us can do our businesses better? I had to borrow $150 from a friend who unawarely put it all on my account and it was all taken by the bank yet it was to buy some food for my family. Someone Please help Bank of america is doing something wrong!
This transaction alone as caused a Pounding headache for the last 3 days, My family had to go without food for 2 day up to when I could get some to borrow me some more money. We are all in some kind of hardship but I hate it when big companies instead of helping the customer look for ways to empty them.

I called 9/11/08 to place stop payment on a check. I gave all necessary information and was told it had been completed. Today I have 7 overdraft fees because the Customer Service Rep did not place the check number on the stop payment. I contacted a supervisor and was told it was valid charges because I wrote a check to a merchent and it as presented by them in good faith. Is there anything I can do about this?

I figured that was because I was online I just did not get them anymore. ANYWAY I just recieved 5 OD charges for 35.00 each! ON PENDING NOT POSTED TRANSACTIONS!
AND when I saw that they may post I went to the bank and made a cash deposit right away! When I calle dnad told them The money was there before posting they informed me they changed that and I got the info in my statement. HOW UNETHICAL is this?

I have been a B of A customer for many years, over the past two years they have gotten out of control with their fees. Not only do they charge me to DEPOSIT money into my savings account (any more than 4 deposits a month is a $3.00 fee) but now they have resorted to changing the days of transactions and therefore causing overdrafts on my account. I have a statement which clearly shows that at no time did my account become overdrawn yet I incurred a $35.00 insufficient funds fee. When I went to the branch to question this charge I was told that I can not go by the online banking statement because it is not accurate and their computers show that the charge was incurred one day prior to my deposit. When I showed them the statement showing them that the charge did not occur on 9/10 but 9/11 when two large deposits were made they refused to acknowledge the online statement and said they could only go by thier computers.
They are falsely advertising that you can check your balances via computer or phone since the information that you access is obviously useless and no B of A customer that I know of has privledges to access their bank account information. This has gotten out of control, the customer service reps are RUDE, dismissive and have told me to learn how to keep a check register. I don’t care how many check registers I keep, if they keep changing dates of transactions it doesn’t matter what record keeping I have, they will always be right and keep taking my hard earned money.
I am a single mother of five children. They are taking my child support that is direct deposited into their account. They should be ashamed of themselves. I have photocopied my statement and have sent it in with a consumer complaint to the Attorney General here in Connecticut. I have already contacted Child Support Enforcement to have my child support direct deposited into a local bank and as soon as that goes through my checking, savings and all five of my childrens savings accounts will be closed at Bank of America. I have had enough of them using my hard earned money to pad their paychecks with. I will tell anyone and everyone how horrible that bank is, not that it will do much but if it keeps one person from being sucked into their banking scams then it is worth it.
I am now short on the payment that I had set up to be paid via the internet. My childrens savings accounts have been raided of their birthday money and my savings account has been depleated to cover the bank fees. I have lost time to hang on hold only to be disconnected. I have lost pay to fight with the representative at the bank to no avail since I couldn’t get anything resolved over the phone. They have caused other checks to be overdrawn since they randomly charge you fees based on their records. I have to check my account daily to see what new fees they choose to tack onto my account and even that obviously doesn’t help since they can rework your transactions to thier benefit when they choose, and the online statement is not accurate – which comes directly from the mouths of their own representatives. The aggrivation and loss of funds are not worth any of the conveniences they offer.

What happened? That is what we would like to know. A payment that is one day late results in a $39.00 fine and raising our interest rate to 29%. This is a legal form of loan sharking. Housing crisis? What about this crisis. I have a credit score of 725 and am looking to find a reputable bank to transfer this account to. Even when you pay early, they tell you that is wasn’t in the billing cycle and charge a late fee. Please help!
Unless I find another company to transfer this to, all I am doing to paying interest every month.

I Had a very hard accident a year ago. I couldn’t pay my mortage or any other bills and now have a better Job and they won;t work with me to help me pay them . They want all or nothing at all . I have 4000 dollars and they won’t take it. And that is almost the whole balance and they won’t take it.
I am sixty one years old , have pets, I am worn out , ready to walk away from it. I am working full time and trying to pack. Daughter having trouble with a pregnacy, mother gravely ill. Don’t know wheather I am coming or going , lived here for three years and lots of stuff to liquidate and I have offered the bank 4000 dollars and they won’t take it . It is all or nothing at all. No one can figure the problems out. Angency wont work with them . Bank of Amercia won’t work with me on this. Had a bad accident and was out of work for awhile.

On August 19th I closed my Bank of America Account. Zero balance. On sept 5th I had an automatic non paper transaction come through. Bank of Amercia REOPENED! my account and made the payment! How can a company open an account and pay something from a closed account. They said that since they had my account number and routing number that they had the right to pay them. I did not know that Bank of America supersides any authroity when it come to desiding that even if the account was closed for 2 weeks, they can re-open it to make transactions because someone has your info.
I closed this account; Now they want to charge me on something that came in 2 weeks after the account was closed! THe Account was closed on August 19th! I went in personaly and closed it!

i ordered a disk about making money on creigs list that came through the mail and was satated the for 1.95 i would get the infomation about this. didnt recive disk and later on the 8th of september i found a charge for 39,85 from Online Business Servives. I called Bank of America and asked them about this charge and said it wasnt authorized (didnt know who this was). bank of america said i had to let it post and had to call fraud.
I tried to cancel this transaction, but they wouldnt let me do so…it now posted to account and brung other charges in the arrears…3…when i called Bank of America and complained about this and asked about this they said that they would investigate the matter and refund money till matter settles…now i ask you this question….why didnt BoA cancel said transaction when i called them 2-=3days before said transaction posted to account instead of letting transaction post and me going through said aggravation….why
up in the air…BofA standing behind said belives that they cant cancle said transition….the other company saying that there was an monthly service charge when they didnt state in the intrum about that and didnt recive disk…so you tell me….why do i have to step up to the plate and say i will pay said bills when said bills are not revieled….

i recently opened an account with bank of america, what a mistake. they can actually put a hold on YOUR money. i work very hard but its difficult to pay bills when a bank want to control every dollar. i think this kind of service is obsured and bank of america needs to realize they are not in control of me or my money. i will for sure close my account with them as soon as i can.
their poor customer service lacks with empathy and concern all they can say is im sorry and explain their text book reason. very very bad customer service i would not recomend anyone to this so called hitler style process. i hope someday soon this bank will fall and it will as long as they keep oporating with this style.

I check my account everyday to make sure things are ok. Today I check my acct and find FIVE overdraft fees in the amount of $35.00 each. I go back through my online statement and find nothing on my part that constitutes these fees, so I call the useless 1-800 number provided. I was told that even though my money was in there, and the charges for each of the debits had cleared. I had made two deposits the day before and the day after, and was still told that it didn’t matter…they were pending charges and warranted the overdraft fees.
I AM BESIDE MYSELF AS TO HOW THIS HAPPENED. I HAVEN’T HAD AN OVERDRAWN ACCT IN SOMETIME AND I THINK THIS IS ABOUT AS SHADY AS IT CAN GET. I HAVE PRINTED OUT MY STATEMENT, AND TAKING IT TO MY LOCAL BRANCH, HAVING THEM REFUND THE FEES…AND THEN WHEN THEY ASK ME IF THERE IS ANYTHING ELSE THEY CAN DO FOR ME… MY ANSWER WILL BE YES, I WANT TO CLOSE MY ACCT.
Besides the fact that the [man] I rented my condo from went into foreclosure and now holding my deposit hostage, and I’m homeless…I am now $175.00 short in my acct and have no money to buy groceries.

This is regarding the handling of clearing of debits & credits to determine NSF charges, all at the convenience of BofA’s discretion leaving the customer with no alternatives other than being at their beckon call. They assess NSF fees on check card purchases that are pending even when it’s a disputed charge (in my case the merchant admitted their error). To try and resolve this you are forced to ‘wait’ until the transaction is posted all the while they charge you the NSF fee when it’s in pending mode. You are then tossed back and forth forced to wait the 12 hour response time to just receive an answer that does not apply to your original question. No one person accepts responsibility and their front line who apparently have no knowledge or authority to resolve problems.
My last complaint is their bank to bank transfers. They debit your money immediately but don’t credit it until three full days leaving you wondering where the money is sitting and you have no access to it. My originating bank admits that they process withdrawals first then deposits which resulted in an NSF activity even when my bank paid the transfer but BofA never credited the transaction until 3 days after the fact. They ended up locking my account from transfers pending a letter from my originating bank that my account with them was in good standing. I immedately had my other bank do this and they faxed to them (following BofA’s instructions) that same day.
To follow through on this, it has taken me 5 emails, 3 faxes, 4 phone calls within the last 3 days. Finally hearing from a Rudy (who claims he’s a Manager), he offered no form of an apology for the inconvenience rather flatly denies receiving any faxes (i have confirmed fax numbers with their agents with confirmed fax receipts), puts the blame on me and decides to empower his authority by requiring more paperwork and legwork on my end. His requirements were not even closely related to what I was originally instructed to do three days prior.
Hardships were no access to money that was debited from my account and loss of personal and work time due to trying to resolve these problems and getting the run around.

My father deposited a check to my new Bank of America account, less than 30 days, on 08/19/08, to help me with educational expenses. The bank did not notify him at the time of deposit that the check would be placed on hold. Contrarily, Bank of America cleared the check on 08/21/08, as the paying bank, Chase released the funds on 08/20/08. Nevertheless, the account was placed on hold 08/20/08 by the bank who claimed the check was fraudulent or counterfeit. I notified Bank of America that the paying bank released the check. However, as of 09/04/2008, Bank of America refused to release the funds that were in my account prior to the deposit of the check in question, and they did not credit my account with these released funds.
According to page 15 of Bank of Americas Deposit Agreement and Disclosures under special rules for new accounts, the first $5,000 of a days total depositand the excess over $5,000 is available by the ninth business day after the day of the deposit. Is this bank allowed to hold on to my funds for this length of time (over 14 business days) and not credit my account with and return the funds released by the paying bank for this length of time? Furthermore, I was told by Carlos, of the Risk Management Department, that a cashier’s check of my funds was sent to the Compliance Department on 09/04/2008, that there is no way for me to contactthis department, and that this check is on hold in this department. I did not have the funds to pay my tuition, as I was a full-time student, and I do not have money to pay my rent and bills. This is completely unheard of and ludacrous. This bank is trying to toy with me and give me the ‘run-around’. I would like my money back.

On September 5th I went inside the branch to deposit my check, the teller notified me that they had to place a hold on my check. I was aware the I only had $101.29 dollars available to me and the there was hold placed on $520.00 I went ahead n made two purchases and never overdrew my account. The minute I found out that the hold was removed (which was 4 days later)I went ahead and withdrew $480.00 and the $20.00 I always checked online and over the phone and made sure i wasn’t negative in funds (which I wasn’t!) As far as knew I STILL had 12.66 after my last transaction.
The next day I had two overdraft fees. They only removed one of them. I called back to see if I could get the second one removed but they said no. I asked if I was going to get anymore fees and the man I was speaking to (Hugo) said no. I checked in online today and I am now being charged $128 dollars in overdraft fees and I never even overdrew! They were being very rude to the point that I even started crying! I am VERY UPSET! I cant believe that this bank steals money and gets away with it!

My husband made a cash deposit on 10/19/07. The dep was made after the cut-off time, so I assumed the amt would be posted on Mon (10/22). Based on the fact that I am very efficient and ck my balances frequently, when I ckd it on 10/23, tha balance did not reflect the deposit. I immediately contacted cust serv and spoke to Ruben who explained that where the acct was opened in Massachusetts, that it would take an add’l business day to post, he assured me not to worry.
A couple wks later I rcvd a ltr to contact the branch mgr, so I did and she said she would have to ck with each teller to see if the transaction was presented. She responded in a couple wks later saying no trans was posted. At this point I am very upset and can now not locate the receipt. I did req that I be able to view the camera surveillance in the bank, she said she will ck on that and call me back, no call back, at this point I have rcvd a ltr on 12/17 stating acct remains overdrawn and I will be going to collection agncy. I am very upset-keeping my credit good is very important to me,
I called Ms Lopez once again who states I am unable to view the surveillance and nothing she can do, so I wrote a ltr to Dawn (Reg Exec) on 12/18/07, no response from her. I am not in collections, which I did dispute, apparenlty the agent is no longer with the agency, when I called I was informed this, spoke to Gordon(Recovery mgr) who states that my dispute never made it back to Bank Of America, so he added it to the dispute log and sent it off–still no response from Bank of America
Now on credit report; resulting in damage to my credit score. Now unable to xfer credit card balance or apply for home equity loan.

I went negative in my account do to a new job and different pay days. I understand that the bank needs to charge fees for NSF, but I had 4 transactions that went through, I had enough money to cover 2 of those until my deposit came in the next day. SO I thought for sure they would cover the small transactions and charge me for the other two. Well they went ahead and charged me a $35 fee for all 4 of them. Which is totally insane when the money was there to cover 2 of them.
They charge you on every little thing. They told me that the way their policy works when it comes to NSF is that they cover from biggest to smallest. So if you have money in your account and you have enough money to cover the small transaction and not the big one, they will not cover the small one, so you’ll get two fees instead of one. INSANE! I can’t stand this bank, they are just not willing to work with you at all.

Bank of America is arranging or doctoring when debits are presented to the bank to charge it’s customers the most fees.
Because of this arranging, they have charged my checking account hundreds over the last year and most recently over $170. I have emailed customer service to dispute the charges and all I get are run-around and a PR response. I’m sick of it.

I was enrolled in credit protection plus by BOA. I did not sign up for this, it was done without my permission. I realized this after 3 months. I called to be taken off in mid-July as I was furious. The phone attendant first told me, I signed up and therefore I could not cancel!!After 30-45 minutes of arguing, I was finally told the money would be refunded and I would be removed from the plan. I looked at my statements recently and found that nothing had been refunded. I called again to complain. They stated they could only refund the last statement (which they never did 2 months later).
I asked for a form with my signature on it showing I had signed up for this service. They told me they were not required to show me this. I then informed them, I would happily pay the cost of the service if they could show me MY SIGNATURE authorizing the plan. The phone attendent responded …I requested a refund and they would only grant 1 month refund for the cost of the plan. He then informed me, I had my choice of seeing my authorization or the refund. I thought this was beyond ridiculous. I told him I wanted to see the authorization and I wanted the refund.
The refund was suppose to be applied for 1 month of the plan cost, none of which has been refunded. Also, the letter that came to me just said I authorized this 4/1. Which I absolutely did not. They are unable to show me my signature or any document verifying that I signed up for the plan.

i had a checking account with bank of america and got in to payday loan debt and they closed the account but they reported me to chexsystems as suspected fraud activity and i did not commit any fraud and this is a nightmare that wont go away and they are very rude and unprofessional and i have tried several different avenues and they dont work
i need some help. this has been 2 1/2 years ago and going 4 more years without an account is ludacris. no checking account

I have recently opened an account at Bank of America. When I opened this account I was NOT told that any checks that I deposited were going to be put on hold for a considerable amount of time. I deposited a check, and looked at the reciept before pulling my car away to make sure they had the date it was and the amount, which it did.
Well I logged onto my account the following Thursday (a full week later) and notice a negative account balance. I call the customer service center and speak with a woman named Rhonda. I explain that I logged online to my account notice the negative balance, but a positive balance on the side. I told her that I looked at my deposit again and then noticed that they were applying a hold on these funds until one week and one day 5pm after I deposited this check. I also told her that I checked the bank that the check was from and it had cleared that Bank 2 days prior then me speaking to her. I told her that now I’m going to be having all of these overdraft fees, and is there anything I can do. She placed me on hold, and came back with that the Bank would as a courtesy to me, they will be refunding these fees, because the bank knows you need YOUR money. I paused and said Okay and was in shock that it was that easy. I Thanked her again and again because I was so upset that this had happened.
Come to today, and I speak to Monday, a supervisor. I explain to her what I had told the previous representative, and that I had admitted that I did not see the hold date on my reciept and Rhonda told me that not to worry all fees would be refunded. She said because the piece of paper they gave me stated the held date, it was there policy that they cannot refund my money to me. I was IRRATE! I asked her how that could be when Rhonda had just told me 3 days prior that the fees would be refunded. Well I was told by Monday that Rhonda was incorrect for telling me that, but I was going to have to pay the fees anyway. I asked if this was a practice to tell customers that fees will be reimbursed and than say oh opps she was wrong and not give them there money back. She then decided that she would try and tell me that I write checks fraduently (which I don’t), try to refocus that the Banks representative was in the wrong.
I have to pay $220 worth of fees, and my savings account is emptied out.

I am charged hundreds of dollars every month by Bank of America! I have acually been charged a 35.00 NSF charge for being short 2 PENNIES! This is crazy and something needs to be done about this bank stealing our money. I have 4 small children and they {Bank of America}, take food out of their mouth every month.
I have paid over 4000.00 in nsf fees over the past 5 yrs.

I’ve had problems with BOA every since I first opened my account. I have since closed my account. In one situation a BOA customer service rep told me that she could block a company from taking money out of my account. I ended up paying $35.00 for the service and it didn’t work. They allowed the company to take the money out and I was out of $155.00.
Back in late May or early June I asked BOA to close my account due to all of the overdrafts and mistakes that were being made. On July 31, 2008 a income tax rebate was deposited into my account that I asked to be closed. BOA took the check as a charge against what they called an overdraft. How can an overdraft occur when I asked them to close my account over two months ago? How can they take a check that belongs to me when the account is supposed to be closed? How come this bank is allowed to continue abusing customers and who protecting them?
According to my calulations BOA owes me over $400.00. I am trying to get legal advice on how I could file a lawsuit against BOA. Those two problems are just two of the problems that I’ve had with this terrible bank.

I was at branch on 23rd Cicero. I went threw the drive thru to make a deposit. Place the deposit into the canster and i asked for the check to be cash and could i please get a balance on my account. The drive thru teller (javier) asked me for my I.D. i asked why know one has ever asked me for it be before. The Teller Stated if you want to know your balance i need to see some I.D. I said no just make the deposit and let me speak to your manager.
the teller told me to come in because it was another car behind me. i was so upset i park my car in the handicap space. came into the bank and asked to speak to the manager. When the manager explain the policy it came to my understanding that none of the bank teller are doing there JOB. I came into the bank to get the bank but instead the teller gave me a deposit slip. I tried to go back in to inform the that this is not what i wanted i wanted the balance they refused to let me back into the bank where my money is the guard threaten to call the police on me if i didn’t leave the bank, but the took my deposit but i couldn’t get good service.
the bank manager did say that she would have to talk to her teller to see what procedure are they using that for my protection they asked for I.D. I was trying to explained Know one has never asked me for my I.D. and why am i being treated like this. Today is 09/06/2008 and my deposit is still not in my account. I was banking at Citi bank switch bank. BIG MISTAKE SHOULD HAVE STAYED WHERE I WAS. On 09/04/08, I received a Bank of America check for services in the amount of $4745.00. I responded to the issuing branch to cash it. I presented the check with a valid photo ID and was told they would not cash a check in that amount because I was not a B of A Member. I was then asked if I wanted to open an account. When I declined, I was again told they would not cash it. I confirmed the check was valid, was issued by their branch, the funds were available and my ID was valid. I was told everything was in order but they would not cash a check in that amount because I was not a member.
When I asked what amount they would cash, I was told that information was confidential. When I asked for a written policy I was told there was nothing they could do and to take the check to another financial institution.
At considerable cost and inconvenience, I took the check to another financial institution which cashed it without incident.

Bank of America (BOA) offered Free for Life business checking accounts in 2004, for anyone opening a new buiness acct along with a debit card and personal account. For the past 3 years, every year all 3 accts get charged with $11 monthly service fees & I have to go thru the ordeal of calling or emailing the bank to have these fees credited. Every year, it gets more & more time consuming & difficult to get these fees credited – since they no longer offer a free for life business account. And then they tell me that they can only waive the charges for 1 year.

I unwilling let my account to go $10.00 negative because of my pay schedule changing. I noticed the change immediately and deposited $80.00 in the account to fix the problem. I went to the bank on Saturday Aug 30th the next day and spoke with someone there. They told me not to worry the charges are still PENDING (Definition: remaining undecided; awaiting decision or settlement; unfinished)and you have deposited the cash before it CLEARED.
Now I go on my short getaway. I used my card 3 more times knowing that I had money in the account. Now Tuesday Sept 2nd (over a long weekend) comes. The first 2 overdrafts they said not to worry about…well they charged me $25.00 for each instance (I also had overdraft protection on my AOPA card). I visited them again asking why this is. After a Ballet of BS which was just a ruse to cover their fraudulent fee practice.
Since they charged me $50.00 in fees I now had a negative balance( before they told me this could not happen because they where pending). Now I have 3 more fee charges to the sum of $35.00 each. Why the change? from $25.00 to $35.00. When I was speaking with someone there they informed me I had no overdraft protection! I HAD TO set it up when I canceled my other Visa card that initially had it and they transferred it to the new card.
I now cannot afford to pay my mortgage on time due to their ineptitude and fraudulent fee practices. This is theft, stealing.
Threatening To Cancel Comcast Saves Man $238.92 Per Year

David used the classic Threaten To Cancel method to save big time on his cable bill, $238.92 per year. Better yet, he did it in the face of Comcast trying to raise his bill. Granted, it was by less than a dollar. But why pay more if you don’t have to? Here’s how he did it.
He told the CSR that he was not happy with service anymore and found it overpriced. The rep tried to get him to to a lower bandwith for a lower price. Dave said no, I just want to cancel. Comcast came back with $33/month for 6 months.
“I said that was a good price,” writes David, “but that I still wanted to cancel…unless he gave me that price for 12 months. He agreed, and now I am paying almost half of the full monthly rate, without having to add more services I don’t need (ie home phone and cable TV), or downgrading It seems like Comcast is very willing to keep the customers they already have, so take advantage of that and get yourself a lower rate.”
